Inpsection/Permit Nightmare

A month or so ago I posted about how DH and I are renting out our current house and in order to do so we need to complete a city inspection.  The house is a 1950's house that was completly renovated prior to us buying and in the sellers disclousure when we bought it 4 years ago it said that they had pulled all the appropriate permits and inspections for all the work they did to the house.  A city inpsection also had to be completed and PASSED prior to them putting it on the market and us buying it.

2 weeks ago we had the inpsection and the city inspector (general inspector) said that no permits were ever pulled back in the day when the work was done prior to us owning the house and we need to pull down all the drywall in our finished basement for them to inpsect the plumbing and electical.  For the last 2 weeks, we went back and forth with the city on how this is not our problem and that their city inpsector completed an inpsection and PASSED it four years ago.  So the city settled on us not having to pull down the sheet rock and that they would send out 3 specialty inpectors  (building, plumbing, and electrical) to see if they could see and inpsect without pulling down the dry-wall. 

This inspection took place this morning and of course did not go the way we want it to go.  The 3 inspectors all felt really bad, but said that yes, the plumbing and electrical were all done completely wrong (not dangerous, but not up to code) and that we need to gut the entire finshed bathroom to redo the plumbing and redo all the wiring in our finished family room to get the house up to code and pass inpsection.

The inpsectors are reporting back to their superior today on their findings and we'll hear back from the city in the next week on if they are going to make us redo the stuff even though they screwed up and passed the inspection 4 years ago. 

We've contacted a lawyer today, but this is the last thing we want to deal with when we are moving into our new house in 2 weeks and have renters moving into this house in 2.5 weeks.

What a crappy day...

  • omg, I'm so sorry that is happening to you.  I wonder if you can go back to the previous owners for compensation.  Although, the city is a large cause of this problem.  Unfortunately the government will probably be the last one to accept responsibility.  Please keep us updated.

  • That is quite a nightmare. Our county doesn't require permits for additions and I found that to be a bit strange.

    The lawyer said we can sue both the city and the previous owners, but the previous owners are going to be just as dumbfounded as us as they completed an inspection of their work and PASSED.  We'll see what the city has to say, but I'm pretty sure they are going to say we have to fix it all.

    If the city passed then and you did no structural, electrical, or plumbing updates since then, can't you just get the copies of the passed inspection reports and fight the city?
