Hi there. I have been married to a man from Germany for 3 years together 6. I have a tax question. He has his green card because he was married previously to another American woman. His mind sense on doing taxes at the end of the year is that he doesnt have to do them because he pays in on his paycheck like everyone else does and knows he wont be getting anything back so why file. He has done this for a few years. This year I told him that he is filing taxes jointly and I am not going to get screwed over by some stupid thing he thought was right, etc. Is this something he could get deported over?

  • I don't know about deported, but I do know that even though everyone gets taxes taken out of their paychecks that doesn't mean that they don't owe money to the government at the end of the year. If he isn't filing and it turns out he did owe money, I would think he could be in big trouble with that if he gets caught.
  • DH is German and has his green card. You have to file taxes... DH even got money back this year.

    He filed taxes the four years he lived here while in school too.

    I would start making calls if I were the two of you. If you were living in Germany with him you would have to pay taxes there so I don't know why he thinks he's immune to filing now that he has permanent residency in the US.

  • And yes he could be deported, not have his green card renewed, and lose the ability to qualify for citizenship. Not to mention if he does get deported he could be blacklisted from entering for 10 years.

    He can't even apply for citizenship unless he has filed taxes.

    Since he has a social security money and he has a job the IRS can, and at some point likely will, find that he hasn't filed and he could be in big trouble, not to mention it could have implications on his green card. He needs to file retroactively.

  • Thank you. That's what I thought. He is going to ammend the last 3 years that he didnt file so he will be current. It was like pulling teeth but he's going to do it. I dont know why he is like that.

    Speaking of being married to a German, what differences do you seen as to how they act differently than the average American man?

  • I don't feel like my husband is much different then an American man. But he was shaped a lot towards that I feel since he went to college in the US. I think he is a bit stubborn and pushy towards goals. He hates when I'm not working hard enough towards something.  I don't know I feel like out main issues stem with his side of the family and not himself.

  • It sounds to me like your H does not understand the American tax system at all.

    There are certain rare circumstances where you don't have to but it's usually because you made almost no money (like under 2k or something) I think. 

    If you file late and you turn out not to owe anything, you generally don't need to pay a penalty since the penalty is a percentage of what you owe. But you are still expected to file regardless. 

  • Yes, he could get into serious trouble for tax evasion, which is, I believe, a felony. And I'm pretty sure you can be deported for felonies. I'm glad he has seen the light and agreed to file retroactively. Even though taxes are taken out of his paycheck in Germany he would never think of not filing there, would he? Same thing in the US.

    I'm also married to a German (live in Germany), but I can't say I notice any differences from the "average American man," whatever that person is like. :-) He loves soccer and doesn't really get either football or baseball, but you can hardly hold that against him. The one thing that I miss sometimes is the childhood nostalgia - we can't reminisce about TV shows or fads from childhood because they were different here. So any kind of Saved by the Bell / Inspector Gadget / etc allusion is totally lost on him.

    I dont think so either. I emailed his stuff to my aunt and my aunt just did his taxes. He is getting a huge refund back. She also explained to him why he has to file taxes and why they need to be done. She is also going to amend the last 3  years for him so he'll be all caught up. Thank god my aunt is a tax pro!

  • My husband has been here since 1998. I am his 2nd marriage. He has a weird personality. He is used to the American life as he learned some of it when he was still over in Europe. He knows some of the popular shows, etc as they were in Germany too.  Married with Children is his favorite He is very abrasive, says what's on his mind, and isnt very tactful. A lot of people say a lot of European men are like that and very stubborn. I sometimes don't know what to expect. He's really into soccer. He'll watch other sports over here on tv like basbell and football. But that's about it. I dont know what else to ask or what have you?
