Re: clicky: drunk driving

  • I don't drive, so I've always called myself the other type of DD - Designated Drinker Wink

  • I know there were times that I should have driven.  I was young, and dumb, and thought I was invincible.  That was a LONG time ago.

Me too! I shouldn't have been driving a few times. Thank god nothing happened!

  • I, too, know there have been times I shouldn't have been driving. I'm not proud of it but what's in the past is done and there is no going back and changing it.

  • I've never come close to drinking and driving, but then again I don't tend to drink a lot.  If I do drink, it's usually one glass of wine at dinner, and by the time dinner is over it's generally out of my system.  I'm pretty adamant about that - too many risks for such low ROI (I'd always rather spend the $20 for a cab)...
  • I've driven after a few drinks, but never when I've felt drunk.

But, after representing LOTS of people charged with DUI and doing a "wet lab" w/ the Washington State Patrol (they liquor you up and do field sobriety tests and breath tests on you for practice and to teach lawyers also), I'm very paranoid about it.  I can guarantee you that .08 is not "drunk" and you probably have no idea of what .08 feels like unless you have been tested.

I can also tell you that when you start drinking and are getting a buzz, you feel much drunker than you do at the exact same breath level when you are coming down.  When I did the "wet lab" at .06 (going up) I felt really tipsy and wouldn't have driven; however after went over .08 stopped drinking and started feeling sober I would have felt fine (like it's out of my system) and driven but I was at .06.  And the Trooper said she would have arrested me.

Another note: you can be charged with a DUI even if you are under .08 if you are impaired.  And you can be charged with negligent driving (still a crime) if you drive negligently after consuming alcohol.  So, be careful!

And if you get yourself in trouble, call me!  : )

Really? That's actually really good to know!

I will say that I have tried VERY hard to be responsible when it comes to drinking and driving but will admit there were one or two times that I wait a bit to drive home, was drinking water, and after it had seemed sufficient time had passed and I felt fine, I drove home...and then 1/3 of the way FROM home realized I wasn't quite fine.

yep, this is true. I had a good friend who was arrested and charged at under .08 (and also a minority, who knows if that had an effect or not). luckily I believe he was able to get the charges reduced in court.

not saying it's good to drink and drive (it's not at all, and aside from one stupid occasion in college I would never and don't ever), but the level of impairment is actually comparable with people talking on cell phones, distracted driving, etc.

  • I've driven when I knew I shouldn't have. I have several friends that have DUI's on their record, most of them learned their lesson.

After my brother became a cop - he made me realize the number of things officers can charge you with if you're pulled over.

Yeah, if you get in a car, they can always find a reason to stop you if they want to.  It's pretty much impossible to drive and not violate any traffic codes.

  • Also, almost no one can "pass" the field sobriety tests and they are subjective, so an officer can interperet them as they see fit.  You will never get out of a DUI by doing them, so don't.  They can only make the State's case against you stronger or give the officer a reason to arrest you.

  • Like other folks, I have driven when I knew I shouldn't - It was about ten years ago when I was trying to make it home for curfew after drinking underage Embarrassed. Nowadays I'm super weird about making sure I don't drink and drive, or making sure that nobody I know does.  Haha, actually after the Super Bowl I was a little more than tipsy (we were staying at a friend's house on the peninsula), and another friend was leaving when they were definitely too inebriated, so I climbed in their car and kept hitting the auto locks when they would try to get in to drive home lol.

By the way, you can also be charged for "being in physical control" of a motor vehicle while under the influence (there's a defense for being safely off the road, but...), so don't sit behind the wheel w/ the keys anywhere near you if you've been drinking!

Yeah, H got pulled over after last year's Super Bowl in Tacoma for speeding. Then the cop insisted he must be drunk just because of the SB (WTF?!) and made him do the field sobriety test...wouldn't let him get his coat, it was 50 and raining, and then bitched that he was "shaking." Well, DUH, it was cold and raining!! He also made him blow in the breathlyzer TWICE because he refused to believe H wasn't drunk. Irritating thing was that we watched the SB in PORTLAND, H had stopped drinking more than an hour before the end of the game (and he had maybe 3 beers the whole course of the afternoon)...and then to be safe, I drove for the first 2.5 hours. I will always stand by my opinion that the majority of Tacoma cops (or State police who patrol that area) are jerks.
