Pinterest - Legal Issues?

http://www.abajournal.com/news/article/pin_with_caution_says_lawyer_who_deleted_all_her_pinterest_posts

Check this out - I don't know what to think?  Should I delete all of my pins?

Maybe Rachel can weigh in???

Re: Pinterest - Legal Issues?

  • That's really interesting!! I haven't read the Pinterest terms of service (and it's only 8:00 a.m. and I've only had two sips of coffee) so I'm not sure what to think of it. I think at a minimum you should give photo credit -- I thought that was enough seeing as how every blogger in the history of ever uses photos from other people and just give credit and no one seems to care, but I've never actually looked into the legal ramifications of it if the original owner of the photo got upset.

As a practical matter, I sincerely doubt that the owners of the original photos are going to spend the time, resources and money to take legal action against someone like you who is probably causing more help than harm to their business! (<---disclaimer, that is NOT legal advice!). It'll be interesting to see how this plays out..

  • Pinterest has become such a huge means of free advertising for so many small business owners - one my newborn sessions has been repinned over 1,000 times - trust me - I don't mind! Unless the repin was in an effort to slander someone, I can't see this turning into a problem because they've received too much advertising or website traffic as a result of the pins.

  • If you click on the images, doesn't that bring you back to the original site?  Good point, but yeah, unless you're trying to pass something off as your own and not just "something cool I saw on the internet" seems like there shouldn't be much to worry about.

Famous last words?  I hope not!

That's what I thought!!!  I hope this person is just making a big deal out of nothing.  I can see how it could get easily out of hand, but as long as the image is attributed to someone, I can't see the harm.

Oh well, just pin carefully I guess :)  Carry on!
