XP from D&R: Building permits, garages, and property lines

The house next door to mine recently was purchased by an investor, and they are going to town with remodeling. There were questions in the past about property lines and if their fence was encroaching. 

We are having a surveyor come and stake boundaries this week. My question is what happens if there are existing structures (garage, fence, deck) that encroach or do not meet the city's building codes in regards to placement along the property line? What rights/recourse will we have (if any) to utilize our property?

  • First, make sure that no variance was granted allowing the encroachment.  We're about to widen our garage, and will extend over the boundary required by standard code.  But we went through a lengthy process wiyh the county to obtain a special variance to do so, making the ecroachment legal.  But you'd have to ask or look it up with the Land Records office to know that.

    If special permits were obtained, there's nothing to do.  If an encraochment exists without them, that I can't help with but a call to the city might help.

     

  • Sometimes properties are grandfathered - meaning that the encroachment has been there since before the zoning was implemented.  Typically grandfathered properties have the right to rebuild or repair the structure as it is. 

     You should probably cal the CEO officer to have them come out and explain everything to you.
