Any family lawyers here

My step son moved in with us 2 months ago.  DH has a court date at the end of the month to have the child support dropped but they can't find the mom to serve her papers. We live in another state.  Will they drop the child support if she doesn't show up to court

  • We are not allowed to give out legal advice in the interwebs, that's how people get sued for malpractice.  You need to call your courts division of child support enforcement; around here they have an attorney on staff who is supposed to handle these kinds of questions.  Or hire an attorney.

    Your DH should already have an attorney, if he doesn't, he needs to go get one.  Custody, support and the like are really much easier.

    No.

    This isn't like traffic court, where the ticket is dismissed if people don't show up.  This is custody of a child.  All of the paperwork and court actions should have been settled BEFORE stepson moved in with you.  Now you are having to do this after the fact.

    Thanks for the info on the attorney on staff, if we can't get the papers served this week DH will call them. I don't see the need to hire a lawyer, stepson decided to live with us so we shouldn't have to pay her child support. BTW he will be 20 next month, he is not a child.
