I was on the stbxh's healthplan up until last october, but added my own plan about 6 months before we separated through work.
I had some medical bills that I paid that needed to be submitted for reimbursement to my own health plan first, and then to my plan under him second (my plan was primary, but I hadn't met the deductible, and I'd met the deductible on my plan under him).
I submitted them early last month after getting the EOB from my plan, but hadn't received the reimbursement.
The good news? I just called the old plan today, and it looks like they processed the claim and mailed out a check (enough to cover the ungodly amt I'm going to owe the IRS). The bad news? Even though I cleared sending all reimbursements for my expenses directly to me with their customer service department last year, because the stbxh was the policy holder, they mailed the check to him...in his name.
This should be fun.

I'm *hoping* that he isn't as ass about this and just mails me the check, or cashes it and mails me a check in my name for the amt. I don't really feel like going to small claims over this, but it's more than $1,000, and I could REALLY use that money for my taxes this year.

Ugh. Sorry you're going through this. Reminds me of what happened to me last year. Was injured in a car accident, car was totaled. When the other guy's insurance company settles with me, both mine and XH's names were on the check because my car had both our names on the paperwork. XH wanted to take the money ($10,000) to pay off the debt we still owed on our short sale. I know what a pain all of this can be. I hope things work out for you.
Legally he cannot keep the money if the insurance company sent him the check for the claim. He has to put that money towards the medical bill. I'm currently handling this at work for our patients because we are considered out of network with one insurance provider so they're sending the patients the checks for the amounts intead of us.
No, no. I already paid the bill. This was a reimbursement from the insurance company. For a bill that "I" paid, not the stbxh. But since he was the primary policy holder, they sent the reimbursement to him instead of me.
