DIY Divorce?

Would you file for divorce without an attorney?  We have a legal separation already in place.  I live in NC if that matters.  

Anyone have any experience with this?  We have no children, and it would be an uncontested divorce.

  • We did it ourselves, but we're both attorneys. And we were in NY.

    I'm not sure how complicated the paperwork is in NC, though. Sorry. Sad

  • We also did ours without an attorney.  We had a house and a kid and did just fine.  I'm in Wisconsin and all of the forms we needed were online (on the State's website).  The Clerk of Courts also gave us a list of forms needed for our "type" of divorce.  Must have been okay because a judge looked it all over and declared us divorced! Oh, and the cost was less than $200.
  • Yeah, I can find the stuff online here too.  I guess I should just print it out and see if it makes sense to me. It shouldn't be too bad since everything is already split, and it would save me a ton of money.  
  • We used a mediator which saved a lot of money but it was still expensive - but I lived in NY which is one of the most expensive places for divorces!
  • I live in CO and did all of our divorce paperwork myself - neither of us could afford attorneys and didn't really have anything too complicated to deal with (and it was *fairly* amicable). 
  • My divorce is not final, so I don't know what the final outcome will be, but so far so good. I'm in CA, and XH and I owned property so we couldn't do the really easy divorce. I was able to get all the paperwork online and then I took it to my county's family law center who gave me detailed instructions about how and when to complete each document and where to take it. They also reviewed my completed paperwork for free. They didn't give legal advice, but they were still really helpful. Perhaps you can research if your county has a free service like that?

  • I'm in VA and have legal separation papers, I would think that since you have it all written out and you aren't arguing any of the details you should be fine to do it yourself.
  • Mine was through the state of NC and our divorce paperwork basically said both parties agree to everything in the separation agreement.  The separation agreement is what cost me $$.  My divorce was around $750 and my hourly fee was $275.

  • We did our own divorce without an attorney and we have a child together.  I think in our case, we are very atypical.

    STBXH gave me practically everything and he expressed that by providing me what I needed before we even separated.  I did have contacts and consent form on me at all times if in the event I needed their service.  We saved a lot of money and saved times from too many appointments away from work this way.

    When my STBXH filed, we actually sat down together and completed the paperwork together so we can be on the same page to make sure the divorce process went smoothly.  So I knew in advance what was on the divorce papers.

    This shocked the workers in the court system.  They continue to give us harsh treatment expecting us to be fighting and everything but nope, we are both as calm as we can be and very simple.

     

  • i did it myself, our was uncontested, no kids, we both agreed on how to seperate things so it was easy. 
  • I suggest filling everything out yourself and then paying a lawyer to just look it over and make sure you filled everything out right and didn't forget anything important.

    That's what I did. I actually misunderstood one question and marked it completely wrong. It only cost me about 100 bucks to have it looked at.

    I'm in WA. XH and I did not have kids and it was uncontested. I found the papers online and filled them out. He signed them with me, and 100 days later we went to court and it was finalized.

    It's just me and my Marlon now... and I LOVE it that way!
  • Well dang sound exactly like our case, I need to figure out how to do that. I live in Kansas. he has a house in his name and bought it before we were married so I don't have to worry about it I don't want it either we do have 1 child but we have 1 truck and 1 car in both our names. He wants truck I want car. but I don't know how to get his name off? Or my name off the truck. How long until you were divorced?

    We each kept our own vehicles, which were in both of our names.  I just went to the bank, with my divorce decree showing that the car was mine and they took his name off of the loan.  I think if you want it off the title, you'll have to go to the DMV with the same paperwork.  However, if the title says "your name AND his name" he will have to sign off on the title.  If it says "your name OR his name" you're good.
