Background check help?

I'm not sure if I'm posting in the right board, so if not sorry...I read further down about someone's husband getting denied due to background check but I'm wondering if anyone has had any issues like mine, or any ideas where to go with this.

 

I applied for a job, heard my application was thrown out(!!) and decided to apply again last week. I got a call back that they remembered my application and would have interviewed except that I had a felony on my background check. This was news to me as I've never been in trouble with law enforcement.

After some digging, I've been told I have a credit card abuse charge (felony) and a possession of marijuana (misdemeanor)  except one charge is in my name and my social, and the other is in this other girls name with my social. From what it's looking like, the police department made a huge mistake rather than identity theft because her social is 1 number off from mine. This occurred 6 years ago one month after the other, and aside from this particular job I have no way of knowing what else I missed out on because of this.

 I'm waiting on the courthouse of that particular county to call me tomorrow and let me know what their thoughts are on this, because I really don't know what leg I have to stand on considering it doesn't look like identity theft and I have no proof in my hands yet. Thoughts? Experience? Tongue Tied Any help is appreciated!

  • Is this for a federal background investigation.  Is the marijuana charge yours?  How do you know that the other girls social is one number off? 

     If this isn't for a federal position (contract or regular) you really can't do much except wait for the court house to contact you.  I would definately make sure to follow up with them if you don't hear back.  And if they don't return your calls, make an in personal attempt to clear this up.  If that doesn't work, I'd hire a lawyer.

    Because of the charges together is probably why your application got thrown out.  People get nervous about any drug charges, but then add credit card abuse to them, and you've got a bigger problem.

  • Neither of the charges are mine. I've never done anything that would get me into trouble like that. I'm not sure what they went through as I paid for a background check through DPS and the FBI and nothing came up under my name. Most everyone I've spoken to said that their checks go through names and not social security numbers also. 

    When I applied the second time, that's when I was called and informed they would have gone ahead with an interview the first time if it hadn't been for the charges. I told the HR person that I shouldn't have had anything come up at all so they sent a second background check. When it came back with the same thing, that's when they called me, said that after further inspection the date of birth and license number are incorrect.

     After a little more information from her I called the courthouse where the charges are from, and that's where it was confirmed that the social security number is one different from mine. The sheriff's office there also confirmed this after she tried to convince me someone didn't read the paper correctly and I told her two people in different counties told me the same thing.

     Someone from the courthouse was supposed to contact me today, never did so I called and the woman I spoke with didn't help much and the only other person she could suggest talking to wasn't there. :

  • I would attempt to get some kind of documentation to the effect that these charges should not be attached to your name. Then when applying in the future, attach that information.
