Changing name back

Stupid questions, but how do you change your name back to your maiden name? Do you have to file he whole change of name petition and legal fees? Or is it like marriage, where they let you change it easily and for free? If it's the latter, what documentation do you need?

I still have 6 months left of our legal separation before we can file for a divorce, but we've been separated for almost a year, and using his name is getting awkward. Especially since we work together!

  • It was in my petition, then when it's finalized it's just like with the marriage. It's super nice to walk in to the DMV and say you're there to change your name, they'll ask for the marriage license and you slap down the certified copy of the divorce decree. You'll still need all the same things that you needed when you changed it for gettin married - birth certificate, etc.

  • If you do it as part of the divorce decree it is included and no cost.  I have no idea how you do it separately from that, probably just like a name change through the court...our D took almost 2 years and I just sucked it up and used his name until then...you can also just change it un-officially (ie, change your e-mail, business cards etc) before it's official.
  • Mine was part of the final divorce decree in a way.  It wasn't part of the PSA, but it was a separate Name Change Order that my lawyer drafted since the PSA was done.  Both were submitted to the court the day of the hearing and the both were stamped and both had the seal placed on them. I did not change my name on anything until the day after my divorce (ok that evening) was final.

    I have mine in the divorce decree and I've heard this is the easiest way to do it and cheaper.

    If you don't have it in your divorce decree, I think you can bring your official divorce paperwork to the Social Security Administration and pay to have your name changed.  Once you get your new Social Security Card, you will need to take it to the DMV to get your license. 

     

  • As PPs have said, it is changed in your divorce decree, and you can use your maiden name anywhere but on legal documents until then. As long as you aren't being fraudulent you can really use whatever name you want.

    Arbor is right.  My sister changed her name, not even having to do with divorce.. she just wanted to tweak it.  Anyone can change their name and for any reason...you don't need a divorce decree to do it.

    I'm just going by what she told me. I am keeping my married name so it does not apply to me.

    It was really funny when I went into the DMV.  The woman said "marriage or un-marriage" and I got to slap down my divorce decree.

  • Thanks for the replies!  I forgot I did a post & run last week when this was on my mind, and totally spaced about it until now.

    I think I'll probably have to go through the full name-change petition, because I doubt it will be in my divorce papers, since Norwegians don't usually change their names when they get married. I'll ask the fylkesmannen (county government office that handles the divorce application) if there's anything extra I can submit to deal with the name thing.

    I guess this (and the one-year separation) is the short end of our simple one-page "print it, fill it out, sign it, and you're done" divorce.

    Maybe I'll ask the embassy. Not that they're ever very helpful, but you never know!
