The realtor is driving me crazy with his lack of effort!!! It has only been two months and there are many details, but if we decide to break off out contract, what is the penalty?

Yeah, you're in for an uncomfortable conversation. Maybe knock back a few glasses of wine and then give him a call? You could say that he seems very busy to you and that you're wondering if he has another agent in his brokerage who might be able to give your listing more focus. It's going to be rough for sure, but you've gotta take care of business.
I'm in PA too, so our agents probably play by the same rules. I can ask mine what your options are when I speak with her tomorrow. Ironically, she was just telling me today how she was never taking another friend or family listing again. She thinks it's too complicated.
Have you tried giving him specific suggestions/instructions as far as what you would like to see done with the marketing of your home? That would be a less uncomfortable conversation to have, and it only seems fair to let him know your expectations before firing him. Then, if he fails to follow through, you can say, "I asked you to do X and Y and you haven't done them, so it doesn't seem like you have a lot to time to handle our listing. Would you mind if we ended this contract so we could find another agent?"
I spoke with my agent and here are your options (unless you have a non-traditional contract)
- You can ask to be let out of the contract outright.
- You can ask that he refer you to another listing agent. If he does, he will still make some money on the sale of the house because he was the referrer.
- If he says no, you can be VERY annoying by calling, emailing and nagging all the time about progress with marketing your house. If/when he does make progress, be as unreasonable as possible at every opportunity. Eventually he'll want out.
If you do get out and you don't already have a listing agent in mind, she suggests go through some sort of referral system because it makes it very easy to be reassigned if you end up unhappy. This is how we found her (my aunt knew an agent out of our area, that agent put us through the relocation department who linked us with our current agent) and even though we signed a contract, one call to the referring agent would get us someone new.
Another option is to find a new agent, tell them your situation and see if they can get you out. Sometimes they'll cut a deal.
