In Attorney Review and ready to walk away

We are in attorney review.  Sellers came back with a crazy request,  the request is that we await their home inspection on their house currently under contract before we move forward.   The stipulate they must find a home to buy prior to closing the sale of the house. 

I told our attorney we must have a firm closing date tomorrow or we walk.   I don't think a 60 day closing request from us is an unreasonable request.

  • Wow, that does sound unreasonable! As a current seller and buyer, I can't imagine turning down a seller because we hadn't yet found housing. Worst case scenario, they should just get a short term lease on an apartment while searching.

  • They should be able to line up an inspection pretty quickly.  Could you give them a week?  That does seem like an odd condition to put on a contract.  

    Hope it works out for you!  If not, there's always other houses out there.  Sorry you have to go through all of these shenanigans from them.  

  • We actually put in an offer on another house the same time as this one and that offer was accepted also.   If we walk away tomorrow we're going ahead and going right under contract with the stand by house.   I'm not dealing with these people's antics anymore. 

    We aren't sitting around waiting for a seller to find a house to their liking.   Plus the backup house, the seller is ready to go and are very accomodating.    I feel like everything happens for a reason and maybe this is the thouse that is meant for us.

    Honestly it was a very hard decision to make which house.  We love them both but in very different ways.  So we are ready to kill the deal if no firm closing date

  • There was a house in our area that sold last year where the owners pulled the same thing. It went under contract TWICE and fell through because they didn't find anything they want. The third time they didn't put the listing active again until they had found something. The whole thing was a 9 month process where two sets of buyers were SOL before it worked out for the third one. Don't be a victim to crazy!

  • I would not be ok with this either. I mean, you don't know how long it is going to take them to find a place! I think it would be a little different if they had a place in the process of closing, and they needed maybe one or two extra days because of the way the dates worked out. But I agree this is not reasonable.

  • Update:  They are under contract on a vacant home (they are moving to a 55 and over community)  it appears all issues are worked out.  I understand they have starting packing their house.    I don't have the final contract yet from our attorney, so when I see it I'll believe it.  However all signs point to it all being worked out
  • I was able to line up an inspection within 24 hours, so hopefully they'll be able to as well.
