Sorry to create another post but Turtles comment about the crazy old lady driving reminded me of what I saw last week.
A woman in a small sedan pulled up next to me, she is smoking in her car with driver side window cracked maybe an inch. Smoking is about as disgusting a habit as there is, but to each his/her own. The problem is that there was a 10-12ish year old boy in front seat and a 3-5ish yr old girl in car seat in the back. I can see smoke in the cabin of the car. This made me furious!!!
I should have rolled down my window and scolded this witch, but I didnt have time because light was turning green. I did however write down her license plate number.
Just disgusted me to no end....feel so bad for those kids!!!
Obviously subjecting the kids to her smoke is morally wrong, but could she be breaking the law? And if I do call someone how would I prove it? Or would you just leave it alone?
Re: Is this a crime? WWYD?
It depends on where you live - I know a few states have made it illegal to smoke in a car with a child.
Persons < than age 6 and under 60 pounds in a child safety seat. Effective 07/21/2006
Persons < age 14. Effective 07/27/2011
07/27/2011

Leave it alone. I don't think there are any laws about this--just social rules that you're a dipshite for doing that. There are Darwin awards and parents who'd love to adopt these children for a reason. Kidding, sort of.
Honestly though, someone with this much of a blatent disregard for the safety of their own children is not a sane person. I'd MYOB.
ETA: Apparently there are some laws, just none in your state.
Ugh. That is horrible and disgusting. Unfortunately I don't think it's a true crime - as in I don't know of any laws that would make that illegal. Who knows though - different states have different laws and some of them are crazy. Maybe it is somewhere? I think parents have the right to subject their kids to their second hand smoke however they see fit.
Like you said, you could never prove it. I'm sure her car reeks of smoke but she could always say she doesn't smoke while the kids are in the car with her. It's very maddening, but I'd just leave it alone.
ETA: Thanks, Arbor. Interesting. See - different states, different laws. Too bad they don't all adopt the smoke-free provision!
OH, MS, GA, NY, and MD are all considering similar bills right now.
As someone who's had asthma since childhood, and who was often forced to ride in cars with smokers, I'm actually in favor of these laws.

Yes, this is a crime here and she is breaking the law! ( ok, maybe not where you live, but if she were here (in CA) she would be stoned!!!)
This makes me so angry
