I have a retirement question

If someone is a rank-select and is being medically retired before they pin on, they can't claim the new rank, right?  Would the time in grade requirement still apply?

Just a question based on fb stalking :)

  • What does "Medically Required"mean? Like they are going up in rank early than normal due to medical reasons?

    Otherwise, then I feel that the same rule still applies, that you can't claim it until it's done.

    We(the Army) have a requirement that you have to hold a rank for two years before retirement that you can keep it post retirement.

  • Oh, then... No I don't think that they will be able to claim the new rank, not unless they were officially made this new rank before their retirement date. This is for VA benefit purposes right? 

    ETA: This is how it happened for a friend of mine... he was a 2LT when he was told that he needed to be medically retired from the AF. He had an exit date of July something. In the mean time he ranked up to 1LT in June. He gets to keep that rank since it happened before he left. If that makes any sense.

    I'm not entirely sure.  I think you can get some sort of pay for a medical retirement.  In her case, she's prior-e, so I think she has something like 17 years in. 

    I can see them waiving the time in grade requirement, but I can't see them letting you retire at a rank you've never actually been, even if you're selected.

    Obviously, I don't know the rules completely. But if she is forced to retire before her "ranking" day, I don't see how they will allow her to claim the new rank.

    But then again, she was selected for it, so IDK.

    Perhaps they will set her retirement date for after her ceremony, signing.. (whatever they do) so she can claim it.

  • Unfortunately, the retirement date was set before the promotion results came out, so I don't think that will change.  It doesn't matter to me, I was just curious.  I think she's wrong about her assumption that they'll honor the selection, but I really know nothing about this.

    I think you're right about her being wrong, but I could be wrong.  

    I agree.  At least for Navy if you're a CPO selectee or LDO selectee, you are just a selectee until you actually pin on your anchors or butter bars.  So if you had to retire before pinning them on you would not get to retire as CPO or LDO.  So I would highly doubt she would retire at the new rank.

  • I think she thinks that b/c she's not choosing to retire, it makes a difference.  I just don't think anyone cares whether it was her choice or not.

    Yeah, pretty much.  Especially when it comes down to retirement pay and pension, they really aren't going to care and just give her the higher rank to be nice.

  • I mentioned this to H who went searching through regs.  Turns out the woman was right.  So, even though other selectees are likely waiting a year to actually receive the new rank, she gets it immediately upon retirement.  Bizarre.
