  It is my understanding that Medicare was not created under the Commerce clause.

  I want to know how Obamacare differs from Romneycare and why one is acceptable and ones not (what is so special about it being ok because it's at the state level vs federal)

  All powers of the federal government are specifically enumerated in the Constitution. All unmentioned powers belong to the states. The argument is that the Constitution doesn't give Congress the power to mandate that people buy something. The counter argument is that because Congress has the power to regulate commerce between the states, they can. Either way, if the federal government doesn't have to power to compel the purchase of something, the states would because it would be considered to be a power reserved to the states.
