Here is the deal:
April 12th
10:30-pre-settlement walk through
12:00-settlement
Today, my realtor told me that she was told that the seller might not be totally moved out by 10:30 but that they plan to have everything out by 12 (settlement). I asked well isn't that the point of a walk-through? to make sure everything is ok, nothing is left behind and nothing was damaged while they were moving out? She said "The seller must deliver a house that is empty of personal property at the time of settlement and is broom clean. It is my understanding that the seller's personalty will be out by the time of settlement. " She said that we can move up the walk-through to 11 to give them more time, but I feel like I'm going to be even more rushed. Am I being too much of a stickler? I'n just trying to protect us and follow protocol. Thoughts?

We're doing ours on the 11th! (9:30 for an 11am settlement)
I think you're being reasonable. I mean, it's a house which is a pretty big purchase and you want your bases covered. I would move it to 11am and if you're late for settlement then they have to wait for you. You have to make sure everything was done post-inspection and check to make sure everything is as it should be.
Were there things that you asked the seller to fix before settlement that you maybe couldn't see if the seller's things are still there? I agree that I'd like the seller's things to be moved out before doing the walkthrough, but if most of their things are out I'd probably just let it go. It sounds like they'll at least be working on it so everything won't still be there.
Our seller had everything out (but had basically been working all night to have everything gone). We pretty much just checked that she had fixed everything we asked her to and were on our way.
This is exactly what happened to us, except no one told us ahead of time that the sellers weren't out.
They promised to be out by closing (the house was only in the wife's name, so the husband stayed behind to pack), but they weren't.
We ended up drafting an agreement that they had to be out by 5pm and we were holding $1000 back in case they weren't.
Their closing on their new house was immediately after ours, but they had paperwork issues and it went on for hours (past 5pm). They ended up not being out until some time the next day and we were really angry because our lawyer told them that was fine with us without asking.
