The color is closest to the 3rd picture.

They look completely different to me, so it's a keep in that respect.
You're still going to be wanting a black one though if that was your original mission, so if you will be passing on a black one to keep the darker khaki I'd say to return it and get a black one. If you are going to keep both and add a black I think it's totally fine.
