Okay so as promised to Ames earlier here is what my Friday evening consisted of:

First a little background on this neighbor. When he and his pregnant girlfriend moved in back in September he made it a point to go around to all the surrounding neighbors and threaten their dogs because of the barking. He told our awesome neighbor on our left side in from of his young daughter that he would kill his dog. Awesome neighbor got in a yelling match with him and it almost came to blows. He confronted us when we were trying to get into our house and I put him in his place by telling him to go ahead and call the dog warden, they won't do anything because all the dogs are either within fences or on runs on their own property and there is no noise ordinance in our town so he has no way to put a stop to it. This neighbor is also the type of person that when you meet him he makes your stomach turn because you can just tell he's a terrible person that would do terrible things to people and animals considering he goes around saying he'll kill dogs for barking.
So anyways back to Friday:
Joel and I decided on take out of our favorite pizza place 15 minutes from our house. We called and ordered ahead so it would be ready when we got there. One of our tenants and his son were outside playing and we asked if they minded if we left Sage out on the run so she could get some exercise and play (the kid loves playing with Sage and Sage loves the attention). So Joel, Alex and I leave go grab our food and come back - we were gone about 45 minutes total. When we pulled into our driveway we see our tenant standing on the porch with crazy eyes. So we get out and ask him "what's going on?" And he then proceeds to tell us that our insane neighbor shot Sage with a BB gun from his back porch.
Here's what happened: After we left, tenant and his son played for a while until his son needed to use the bathroom. So they went back up to their apartment, Sage barked after them when they left, you know typical dog behavior. Then while in their apartment tenant #2 who was watching TV hears a *pop* *pop* *pop* sound and yells to tenant #1 who is in the bathroom - he looks out the window which is directly across from the neighbor's back porch and watches the neighbor shoot the BB gun into our back yard. Tenant #2 also had gotten up and went to the kitchen window which is next to the bathroom and saw this all happen.
When tenant #1 saw this he freaked out and sprinted down the stairs and out around back to then see Sage running and shaking along the fence as far away as she could be from the neighbor. He yelled at the guy like crazy and told him he was going to call the cops. The neighbor denied it and went back into his house. This all happened about five minutes before we pulled into the driveway to see our tenant with the crazy eyes on the porch.
So I called the police, which I've never done before and explained what happened to the dispatcher and the sheriff was here within 20 minutes (which is way fast for our rural little town). He had us check Sage over while he was here to check for injuries so we could report them - but there were none. I think she definitely got hit but it didn't stick in here or anything. Both of our tenants came down and we explained what happened, tenants filled out eye witness reports and then sheriff went next door to the neighbor's apartment to speak with him. Surprise surprise the neighbor didn't answer the door - the cop let us know that he would go back over and try again and would be patrolling the area tonight should anything else happen (like retaliation from the neighbor towards us for calling the cops). The sheriff said he would be turning his full report over the DEC and the dog warden and they would be contacting the neighbor to issue tickets.
We haven't seen the neighbor since. Joel and tenant #2 saw the girlfriend putting laundry out on Sunday morning but that's all we've seen. I'm just waiting for the piece of sh!t to appear and say anything at all to me. I will rip him a new one so fast his head will spin. Sage is now all nervous when we put her out and she just stares up at the neighbor's back porch. We moved the run so it's no longer in the middle of the lawn, it's now in the back corner closer to our other neighbor (who is awesome) so now the dogs (tenant #2 has a small beagle with epilepsy - it's a good thing it was Sage that got shot and not him because I think that would have been much worse) are protected by the tree line from any BBs shot from the porch.
So now we'll just wait and see. Joel called the sheriff's department this morning to check on the status and the sheriff is out of town for a few days so the chief left a message for him to follow up with us on what the course of action will be. It's likely we'll only know about what tickets were issued if the neighbor pleads not guilty and we have to go court.
Re: The Story of My Insane Neighbor
Amen. I'm sorry that this happened, and it could have been so much worse. Hopefully the DEC brings this guy to justice, although I'm sure you'll have to go through a trial. Another thing- is he a renter? If so, a violent crime involving a gun on the property (even a BB) can trigger eviction in some places. Just in case you felt like looking up the property owner via local land records and getting into contact.

Yes indeed. It's fortunate that Sage wasn't injured which I credit our tenant for because he ran right out right away - if he hadn't I don't doubt that the neighbor would have kept shooting. Also we did contact the landlord Friday and again today and left messages. Joel will keep calling until he gets through to her. The town is all in an uproar over this - I grew up here and it's a tiny town and Joel works with my Dad at one of the small business here and my family is very active in the church here. We all watch out for each other which is one the big perks to living in a small town so I have no doubt that there will be consequences for him. I'm really hoping for eviction because he's such a creeper. I do feel bad for his girlfriend and their young baby who is only about three or four months old.

That is just plain old ridiculous. I would be livid. And even though I wouldn't do this (as I would want to follow the law and make sure sir douchelord gets what's coming to him), my ass would have marched on over there after the police, pounded on his door and when he opened it, punched him squarely in the jaw.
Danny & I just had a conversation 2 days ago in which I told him if someone would hurt my dogs and I would be witness to it, I would be in jail because I would chase the *** down and beat him/her senseless with my bare hands. And I am not a physical person--at all--so the rage would be there.
It blows my mind, the crazy high amount of sick people out there. My ass would be sitting in the window all Lee Harvey Oswald with a paintball gun just waiting for that guy to walk out of his house.....
Hope the law helps you out and your community stands behind you and the bastard gets evicted.
Yeah Joel and my mon had to talk sense into me because I was going to go over there and provoke him to hit me because then he's be in jail for assaulting a prefnant women! But they talked me out of it.
I really hope something happens though because now I do not feel safe with him next door & I shouln't be made to feel that way in my own home.
Oh I will definitely keep you posted. We just learned another anazing digusting fact about him & the gf. Apparently they went to a party at a neighbor's house down the street (another house broken into apts) and they got drunk and LEFT THIER BABY THERE OVERNIGHT. Now the person who lives there had babysat for them before but they didn't ask her to watch the baby before leaving. She disn't even know the baby was there until she heard it start crying in the other room. She took care of it for the night because they had left the diaper bag with a bottle and then she had to call them at 6am to tell them to come get her!
WHI THE FUUUCK DOES THAT?!?!?! I am shocked. Shocked! Clearly the gf is mo smarter and no better of a person than he is. If I see first hand any of that behavior towards the baby so help me god.......Seriously WTF is wrong with people!

This warrants a call to CPS. That baby should be removed from their care. Like, NOW.
Will CPS do anything based on second hand information? I've fortunately never been in this position before. I don't want to jump the gun but I also don't want to stand by and do nothing. When I've seen them with the baby the gf is always good with her but who knows how it is behind closed doors and I've never seen him hold the baby or feed her or anything in the public situations we've seen them in. So idk, clearly they're not capable of makin totally sane and rational decisions while drinking so hopefully they don't drink often.
I honestly don't know for sure, but I think if you call in an anonymous tip that you suspect abuse or neglect they will at least check it out. if I'd been your neighbor, I would have called CPS and/or the police when they left the child, rather than calling the parents to come get her.
As a mandatory reporter, we were always told that it's only our job to tell CPS what we know - whether it's second hand info or not. Its their job to investigate, not yours. So even if they can't launch a full investigation based on the info you provide, it's the beginning of a paper trail. So that way, the next person who calls, even if it's just second hand information, they can see a pattern. Then they can start investigating.
It can't hurt to call. I think that's absolutely insane that they left their kid at someone's house. Combined with what happened with the BB gun? You know this man is crazy. It can't hurt to start even more of a paper trail, you know?
Ah ok, that is true. I'll look into it so like you said st least then there is a paper trail on them.
I am soooooooo glad that Sage is ok ! I really hope that guy gets what he deserves. The gf doesn't sound much better, given how they left their kid like that.
God help the person who attempts to hurt one of my dogs. I would go all crazy @ss on them. Even of I couldn't physically hurt them, I would find some other way to get them.
