I just found this interesting. Marked as March 30, 2012 so it's new. elenetxu I don't think this something you could do at all. But it's interesting to see that they are sort of reconstructing US spousal visa.

The immigration fees also ironically went down a little. Which I find hilarious because when does the government ever lower their fees. :)

    The first link is interesting, I wonder what kind of hardship you have to prove?

    Immediate relatives can obtain a waiver of the unlawful presence bar if they show that a U.S. citizen spouse or parent will experience extreme hardship if they are required to remain outside the United States. The immediate relative also would have to show that they warrant a favorable exercise of discretion.   But in order to obtain the waiver, these individuals must depart the United States and wait abroad while the waiver is processed.

    I wonder too. I know there are some cases were the US Citizen Wife is pregnant or the foreign spouse is pregnant. I would imagine that to be a hardship  if I was in that position.

    I read a story of a women in Brazil who's US citizen daughter was very ill and they were together in Brazil and husband in US. The daughter really needed more long term medical attention then Brazil could provide. Baby was under 6 months and there was no support system for father to bring her to the US with out the mother.
