HR nesties, esp healthcare/medical field ones...? about background checks

MH did a stupid thing last September. Dont all crimes start out like that? He did a return and exchange under false pretenses and ended up arrested for theft by deception 3rd degree because it was electronics. He NEVER did anything like this in his life and did spur of the moment! he is 30 years old!  It was very out of character. He was unemployed for awhile and I think he hit a low. I also think he didnt look at it as theft since he was returning an item thinking the store gets credit. Regardless no excuse!! Anyway, it was pleaded down to Disorderly Conduct-theft by deception less than $200.

He has an interview coming up. Obviously if they ask if he was convicted of a crime, he has to answer yes and explain. However if they ask felony he says no because its not a felony, it was handled in municipal court and is disorderly persons. However, it will be on background check.

Question is, he is trying to get a job at a Physical therapy facility. Its for aide position. Will this prevent a job offer if he is qualified in every other aspect of the job? Will they take into consideration that he had a moment of stupidity since he never did anything criminal before. Granted it is one time too many....is there forgiveness for low level 1x offenders? Would your job hire him?

I feel sick about it as does he. He never had to worry about this before for interviews and now it will follow him for 5 years until expunged and he has to live with it for rest of his life. He entered counseling after because he was so ashamed of his actions.

  • The circumstances do not matter only the company policy does.  For example I am a corporate recruiter.   There is a spreadsheet (internal only document) of every crime possible under the sun.  If during the application process a person admits to a crime I check the spreadsheet for that crime.  Right on the spreadsheet it tells me if the person is hireable or not.

    It does not matter what long explanation the person wrote for why they did the crime or why they were convicted.  Trust me I have seen every sob story known to man. We dont even read them b/c there is no gray area on this.  There is just a yes for "hireable" and a no for "not hireable" for a long list of crimes.

  • I work in HR/healthcare.  We do background checks on every new employee, and yes, that would disqualify him.  It *might* be ok if it'd been 7+ years ago, but it was pretty recent.

    It depends on their own policies though.  Some places just reject violent crimes, or theft from a previous employer, or sex crimes, etc.

  • I don't work in healthcare, but we have a similar policy. I'm not sure where your H's crime falls on this for my company, but I wanted to add that if the person lies on their application and does not disclose the crime they are automatically rejected no matter what the crime was.

    Another company I worked for looked at convictions on a case-by-case basis and would hire based on the circumstances, and if they felt the person had learned their lesson and moved forward in their life they would absolutely hire them. It was a retail organization and were known to hire people that were convicted/plead guilty to shoplifting and/or stealing from the till.  

    I hope your H is able to find a company willing to hire him, and you guys are able to put this behind you!

  • Thank you for your responses. I hope he gets a job soon too! You never realize how hard it is and some dumb choice will  follow you years later and causes an immediate judgment of your character and ruins your chances for jobs and schooling.

  • Does he need to stay in the health care field? I think its more likely to have black and white rules about convictions.  My husband had a misdemeanor from when he was 18 he was worried about explaining in an interview. He has luckily always found work for small companies that didn't do any background checks so its never come up. We had a hell of a time finding an apartment to rent because of it, but he found a job right out of school. There also may be small, one doctor, practices that wouldn't bother with background checks you H could look at. Good luck! I know its stressful.
