CN: The U.S. Marine Corps has decided to discharge (other-than-honorable) a sergeant for criticizing President Barack Obama on Facebook. It appears he was warned a couple times prior to the discharge.

 

Do you think it's fair or okay that Military members can't publicly express their opinions? (Therefore, restricting their 1st Amendment Right?)

  • Nope. He posted on a public forum that he would not follow an order from his Commander in Chief, they have every right to boot him.

  • Well above all else, the President is his Commander in Chief. Soooo, regardless of first amendment rights, that's insubordination. In this quote,  Another document brought forward in an earlier proceeding revealed that Stein posted on a Marine meteorology and oceanographic Facebook page March 23, "As an active Marine I say, 'Screw Obama' and I will not follow orders from him." he was speaking as a Marine, on a Marine page. No good. I think the discharge is apt.

  • If an empolyee of yours posted on your public FB page that you suck and he would refuse to follow any instructions you gave him, would he not be fired?  I'd fire his azz in a heart beat.  You don't want to work for us?  Fine.  Get the hell out.  This guy was given mulitple warnings and continued.  He should be fired and his behavior sure the heck wasn't honorable.

    Just because you have the *right* to say something, as provided by the first ammendnent doesn't mean there's no *consequence* for what you say. He had the right to say that and his consequence was a dishonorable discharge. Walla

  • He was/is a sergeant, a position of leadership, so his decision to not uphold the oath he took upon enlistment doesn't just affect him, but the men he's charged with leading.

    "I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to the Uniform Code of Military Justice.  So help me God."

    He didn't own up to his end of the bargain.  Too bad, so sad.  That oath doesn't say, "I will obey the orders of the President, provided he's the one I voted for."

    This guy served for 9 years, so obviously he cared for his country and obeyed orders from the President (although indirectly).

    Logically, it bums me out because of all people that should be protected by our Constitution the people out there fighting for them come into my mind first.

    I've seen a lot of military surprise homecomings. It wouldn't work on me. I always have my back to the corner and my face to the door. Looking for terrorists, criminals, various other threats, and husbands.

    he's still protected by the constitution. He was free to say what he wanted. He's not in jail or being killed. He lost his job. He continues to be free to say what he wants. His expression of his rights came with a consequence. As far as I know the constitution doesnt guarantee no consequence for things. 

    Another example of the misunderstanding of what the constitution is supposed to be protecting

    Exactly. I can talk shiit about my job all I want. But pretty sure I can't go on a sponsored page for my job and talk about how I'm not going to listen to my supervisor and then not expect repercussions.
