signing contract with realtor

We have been looking at homes with a realtor for about two weeks now. We currently live in an apartment, so we are not selling a house, just looking to buy one. She has not asked us to sign any sort of agreement or anything with her, which surprised me because I expected her to ask us to do that by now. Does not having an agreement with her hurt us at all? Should I ask her about it or just wait and see if she brings it up? And is there anything in particular I should be sure is in the agreement before we sign it?

  • Some buying agents do and some don't. It usually depends on your area.

    I'd wait and see what she says. Not having an agreement is better for you. Even if you like her and she is a top notch professional being tied to someone specific isn't ideal.

    If you do have to sign one, I'd do it for 3 months and no longer.

  • We didn't sign one with ours until we put in our first offer. If possible make it an agreement with her brokerage and not her. This way if the relationship goes south, you can get another agent from that brokerage.
  • We never signed a contract, even after we put in the offer on our house. If the offer didn't go through we had no obligation to the REA. This way if we didn't like the way that she represented us during the offer we could walk away from her all together.

  • We were only asked today about four days after our offer was accepted to sign a contract with our realtor. It was pretty straightforward.

    Not true in all markets.  In some states this is the opposite.  By default, the agent has the seller's best interest and not yours if you have not signed a buyer's agency.

  • We signed for six months....im in a realtor nightmare, if you can hold off I would. Wait for them to bring it up.
