S/O wills - ? about MD law

Hello all,

I'm not asking for legal advice, but I do have a question about MD law. What happens to surviving children if both parents die and a legal guardian has not been named? What if no immediate family live in the state?

I'm just curious. I think I know the answer, but I am hoping it will spurr DH and I into action, re: setting up wills and a trust.

  • I *think* unless there is a custody dispute they are appointed a Guardian by the court (who's normally a retired judge) and that Guardian oversees the child's interests while the relatives have physical custody and manage day to day care, etc.  Assuming nothing bad happens and there aren't disputes about custody, the relateive will be appointed Guardian of the minor.  I'm sure if there a delay w/ getting a responsible relateive to take custody, the child might have to go into Foster Care or some kind of group settign for a short time (while the relative travels from wherever)

  • we cannot decide who gets kira if something happens to us.  we don't agree. :(
  • Fortunately, we agree who gets DD, but we are trying to decide if we should create a trust administered by someone who is not DD's guardian.
