So on Tuesday I walk outside to go to our garage and there is this guy taking pictures of our house. So when he see's me he says that he is just taking pics for the insurance on the house. I'm like okay, whatever. Last night same guys shows back up and hands Ryan paperwork & his card (Ry answered the door when he knocked). This guys tells Ryan that that house is being foreclosed on ( which we knew, duh!) and that we are going to have to leave and call him tomorrow and he can help us out. Well the paperwork he hands us is dated August 25, 2011 and is for the wrong address and isn't even our mortgage company. So Ryan calls the guy a few minutes after he has left and explains yeah so you didn't give us the right paperwork and the guy like of sorry about that and still preceded to tell Ryan that we have to leave the house. This only angers Ryan more because this guy has nothing official from a court saying this. After Ryan gets of the phone and he tells me what happened I tell Ryan that I'm 98% sure this is the guy who said he was from the insurance company. This does not help to calm my husband so Ryan calls him again and asked if he was the same guy that was taking pictures for the insurance company. Guy admits that it was him and when Ryan asked which insurance company the guys couldn't come up with the name and tells Ryan its is for the PMI insurance. Well our house never had PMI insurance. So when Ryan calls him out on it the guy starts cussing and berating Ryan telling him that were losers, worthless people and he will get us kicked out of the house. This went over well as you can imagine. Ryan was upset, pissed, mad, angry for hours after. Called the main office for which this guy works left a message, emailed the main office as well.
Right now we are just waiting for the mortgage company to go through the court to evict us. When we relinquished the house in the bankruptcy our lawyer let us know the steps it would take. The back log for mortgage companies having to do so could allow us to stay here for a while. This coming October will be the 1 yr anniversary of the bankruptcy being discharged. We have heard from other people that they were in their homes for up to 2 years after foreclosure. The only down side is once we get the eviction notice we have 30 days to leave.
Needless to say that in an already stressed filled home this didn't help.

Holy moly! This sounds like something from a movie! That guy sounds really shady..... fill us in when you hear from the mortgage company.

Deeder - that is some bs. I hope that you get some answers soon.
BTW when you did banruptcy and went to the 341 meeting, did you have make any ammendments at all? Once you did the ammendments, did you still have to go back to court or not? I had to do two ammendments that have been completed and supposedly I don't have to go back to court in Sept (lawyer says that), but I don't know for sure?
Hey ladies! I am just waiting for it to rain. It is so gloomy here but no rain yet. At least its cool out and I can have the doors and windows open for fresh air!
Deeder - that guy does sound shady. I hope that you guys are able to figure out what he really is up to. It's odd that the paperwork is from 2011 and he didn't have answers to your H's questions.
Just found out that DH has to front all of his travel costs (frequent travel for week + at a time) and then get reimbursed. I'm not too pleased, as I could see this screwing us badly if their reimbursement person doesn't stay on the ball.
I think I would've called the cops on that guy & told them someone was trespassing. Even if he's legit, he shouldn't be lurking around & hassling you.
That's not cool. I'm surprised they don't issue a company credit card for travel expenses.
Sorry to hear everyone's foreclosure experiences :-( Mine was pretty smooth as my ex was disappeared at the time and my divorce lawyer just faxed the mortgage company telling them I had no idea it wasn't being paid and that I wash my hands of it. His parents helped me clean the house and we left the keys and garage door opener on the counter. It never showed up on my credit, which is pretty cool. Not sure what XH and his dad had to do for it though. Out of my life by then!
With the amount of travel required, I really don't understand not having a company card. This seems like a really good way to get screwed over.
We're starting to look into buying a different house & you all are freaking me out with your foreclosure stories. What do you wish you'd known before buying that might've saved you from these major hassles?
That market was going to tank and we would both lose our jobs and SS birth Mom would skip paying child support for 6 years. For us it was mostly timing.
I would also do more research into who I'm dealing with as far as financing. We used a friends brother and some things didn't seem up and up afterwards. Ryan didn't get any 1st time home buyers credit or anything in that way.
We didn't have a 341 meeting so I'm don't have much to tell you. We payed the lawyer in March, Meet with the Trustee in July and were discharged in October. Other than the house we didn't have a lot to claim in the filing. I was trying to find more things so it actually looked worse.
That my XH, who I'd known since gradeschool, would turn out to be a lying methhead who would leave me for a crack whore :-)
Actually, a bit of advice . . . when DH was looking for a house (we weren't engaged yet but planning to soon), we decided to only go on his credit and income and let that decide how much we would qualify for. That way we wouldn't be house poor. I'm really glad we found something fairly inexpensive that we love. Also we bought right at the height of the bubble so I'm REALLY glad we didn't buy an expensive house thinking it would increase in value! We just refinanced, and it's a comfort knowing that even if one of us loses our job we'll still be able to pay the bills.
I truly hope there is special place in hell for people who abuse children and animals.
SO does side work for his boss by cleaning out the bosses rental houses. SO called me on my lunch to ask if I would bring our latex gloves over to him because this house was so disgusting. When I get there, he tells me there is a cat just inside the house living....the people have been evicted. Of course I couldn't just leave the thing, it was starving. So I called the animal shelter the next county over because they are a no-kill. They couldn't take it because they were at capacity so I had to take it to the local one. I'm sad about that, but really had no other choice because SO is allergic, so we couldn't keep it. When I arrive, they inform me that they picked up the same people's dog yesterday. Who does that?? Just leaves an animal there to die. UGH.
I think there is, I believe these people enter through the 4th gate of Hell.
Seriously though WTF people. People like this should be blacklisted from owning animals.
Animal control has their name so I hope they are prosecuted.
Did you file chapter 7 or chapter 13? I am doing chapter 7. I met with trustee already (341 meeting) - I have to make 2 ammendments - have to provides financial statements from new bank (which I did when I paid attorney) and the cash value of my life insurance policy. Got those to lawyer real quick AGAIN and I shouldn't have to go to court again in Sept but he'll let me know.
We did Chapter 7. But ours was really clean and quick and easy. It could have been because we weren't working and what I made at a PT job didn't matter enough.
The more I learn about how they do this, the more nervous I'm getting about it. Considering he has to pay for a week's worth of travel & hotel, make the reservations in advance, & then not get reimbursed for up to two weeks after his return, I'm concerned about being able to pay the credit card bill on time. We haven't missed a payment, or paid less than the full balance in years. I don't want THIS to be what screws up our credit & prevents us from being able to get a house!
