Name Change Issue...

Both H and I changed our last names to MyLast-HisLast and have changed our name on almost everything except a few bills.

My student loan lender required a formal letter explaining the name change with my account number and a copy of the marriage license as did 2 of H's 3 loan lenders.

The 3rd sent a letter when H changed his name with SS as it showed up on his account, they then sent a letter explaining he could send copy of marriage license, drivers license, or SS card to show proof of name change. He chose marriage license and sent it in the mail.

They called yesterday and left a message explaining that he needed to call regarding his account information. He called this morning and they told him because he is a male that has changed his last name they need a court order?! 

We are so confused because no other agency has asked for this regarding his name change.

Has anyone experiences this before or know of someone that has?

    I am not bothering to change my name on my student loans...just paying them off, it doesnt make a difference to them as long as they get the money back, if I take loans out in the future they will be under my married name, but for paying this set back, I just plan on paying it as it, they have no reason to need my new last name as they are no longer lending me, just making me pay back.

    I agree with this. If it is just something you are paying back I wouldn't worry with changing it. I still haven't changed my name on any bills just banking and DL and SS that type of stuff. 

  • Oh hell yes they gave me that crap and I almost lost my s**t!!!  The BMV by my house is staffed by complete idiots and when I went in there with my Marriage License, SS card, current drivers license (that is everything they should have needed) and all my other forms of ID just in case (ie birth certificate, name change papers from when I was 6 weeks old) they told me I needed Probate court to change my name before I could get a new drivers license.  That form requires and ATTORNEY!! I said "ummm no.  I just got married, I'm not doing anything out of the ordinary. I GUARANTEE YOU every married woman does need an attorney to change her damn name!" Well, we argued for about 20 minutes, she offered to call the capital to straighten things out and sure enough, I was f**king right! Of course I was right, those fricken idiots....

    Anyway, back to your story.  I frankly think it is sexist of them to make your H go through probate to change his name and you didn't "because you're a woman and women are supposed to change their name and men aren't."   According to the SS office that I went to, all you should ever need to change your name on anything is your Marriage License (a reason to change it) and your SS card (The name it is being changed to issued by the federal government).  Don't back down on that and please don't give into the attorney crap for a marital name change.

    Also, there are a few things I didn't bother changing my name on- my car loan being one of them, and actually my old credit cards (I might eventually change those, but I was planning on canceling at least one of them very soon).  I know you had mentioned you were a teacher and I'm currently working on a licensure, so I'm constantly going in for background checks for work and school and stuff.  When they look at my drivers license they ask me if there are other names that I go by and I do tell them that I have a few credit cards and loans under my maiden name- I suppose to the federal government that is considered an alias, but as long as they know about it, they don't care.

     I changed my name on everything, including loans.  Your credit score increases over time by you making payments, and if your name is different on the loan than what it is legally now they might have a hard time putting it on your report or might think it is a mistake.

    I think what they are doing is not legal, I'd consider that gender discrimination.  I'd tell them that you've changed his name with all your other companies/etc. and that if they don't change his they'll be hearing from your lawyer.

     Sorry to hear they are giving you such problems!

I agree with PP who said that it's worth it to change your name on existing loans that you're paying off though, they will help your credit score. There is a chance that your old loans might show up on your credit report since your birthdate and SSN will still match, but you might might flagged if you have two names showing up under the same SSN so it make take longer to get credit sometimes. It's always a good idea to update your financial stuff.

    We live in Quebec and we're not legally allowed to change our names here. We can apply to change our names after we've been using another name for 5 years. I use DH's last name socially but my licence, medical stuff and banking is still all in my maiden name. My work was really cool though and lets me use DH's name; they changed my business cards and email accounts and everything! Hopefully in 4 years and 9 months they'll let me change it. Poopy French province!

    That's just weird to me.  Altough I've heard other countries doing this too.  Hmmm

    Anyway...I would definately change my name on all your loan stuff too.  You're building credit with each check you write (that was my dad's silver lining to me when I had my one to pay off) and it would be alot easier for you to get this figured out now, rather than in a year or two when you apply for a house loan.  Trust me, credit building is a big deal.  It just may not seem like it right now.

    Secondly, I have never known a male that has changed his name due to marriage (mid-west, we keep it pretty traditional around here!) but I like the idea.  I would think he would need to do the exact same process you would need to do.  I would call them again and explain what is going on.  I don't scream the word discrimination, I'm just wondering if they just haven't dealt with it before and are confused.

  • It is a student loan from college. I did a little research last night and there are only 5 states (including MA, where we live) where a man can legally change his name the same way a woman would. In all other 45 states he would need a court order. The state of MA has recognized his name change. The state in which the loan is from is a state that a man would need a court order to change name.  

    We will not be getting a court order, H will have to ca and explain the laws in MA.
