We spoke to our attorney about a will. Our main concern was lining up someone to take care of A if something were to happen to both of us. He brought up Power of attorney and health care proxy. Since both of us are healthy these would currently be for emergency situations. Just wondering other people's thoughts on them. Do u have those? DH says to just do it all now. TIA
Re: Do you have will???
we don't have a will yet, but we are meeting with someone to make one after Sophie is born. It's for the same reason- to line people up in case of our deaths. We have designated a person and an alternative just in case. DH already has my health care proxy. Hosptials may give you the form if you ever go in for a surgery-that's why he has mine. We don't have powers of attorney currently though.
Here's the HCP form http://www.nysba.org/AM/Template.cfm?Section=Home&ContentID=10002&Template=/CM/HTMLDisplay.cfm
Here's the POA form http://www.nysba.org/AM/Template.cfm?Section=Home&CONTENTID=41935&TEMPLATE=/CM/HTMLDisplay.cfm)
These forms are important if you have strong opinions about life support and such and have your own finances that someone will need to handle upon incapacitation. I figured I'd attach them for you to see if you think they are appropriate for your situation. If you are going in for the will, your DH might be right that it's easier to get the whole package done.
We have both a will and health care proxies. We did them shortly after A was born. My job has a legal program that we could get them done through so it was pretty easy. I went to a local lawyer in the program, answered a few basic questions (all about who would be looking after A and his finances) so that he could set up the documents.
