Problem with Neighbor's Kids

Coming home from work on Wed, H and I noticed that the ladder to our pool was completely pulled up by the bolts. It's as if someone was on the ladder, leaning back while holding on, and it pulled up and broke away from the deck. Neither of us have used the pool in weeks, so it's pretty safe the say it was the neighbor's kids while we were at work, which also means it probably wasn't the first time. Our neighbors are an older couple and their grown son and his three kids moved in around the time of our wedding. Our other neighbors that we get along with well have warned us that the son is an a-hole and the kids are out of control, which we've noticed ourselves just by living next door. Since we didn't actually catch them in the act, we can't accuse them. I've never been in a situation like this before and not sure how to handle. Any ideas?

  • Can you set up a camera somewhere to try and catch them? Then you would have proof and could say something to them. The only thing I can tell you is without proof maybe talk to your neighbors about their sons kids. 

    Next time you come home and notice something like that you can always call the cops and tell them you suspect the kids but 3 days later won't do any good. 

  • The issue with this is you could possibly be liable if something happens to them while they are in your pool whether you are aware of it or not. I would definitely try to record it or at least make reports every time you notice this, with copies to your neighbors, just in case.

  • my first thought is to put up a motion activated camera, and i think if you put up a no tresspassing sign to your backyard and the kids still go back there then i think it might save you from any liability.  you might want to look into that though just to be sure.

    i also agree with talking to your neighbors about their son's kids.  don't accuse the kids, just mention something about some 'neighborhood kids' might have been in the pool, it's dangerous, yadda yadda, don't let your grandkids back there, etc...

  • this is a little expensive but can you put a fence around the yard?  Check what the fencing laws are in your area to make sure that if anything happens in your yard you are up to date on the law so you are not liable.  Cameras is a good idea.  Also if you are home one day hide your car so they don't know you are and maybe you can see them.  I would also make a report with the police of the property damage so you can have it documented

  • Tough situation.  I was thinking of putting a camera in, and then confronting them/the parents with the evidence (if it is indeed them).  If the parents aren't cooperative, then I'd get the police involved and see if they can write them trespassing tickets or something.

    I agree with this. It's so unsafe for these children to be in or around your pool without supervision. In MA we have a law that states you need a four foot fence around your pool. But I guess if they want to get in kids will always find a way.

  • Thanks for the suggestions ladies! I've been so busy at work this is my first chance in almost a week to sign on.

    We actually have the entire backyard already fenced in... I guess that wasn't enough. The dad isn't reasonable at all and H has spoken to the grandparents before the pool was open about the kids ending up in our yard. I like the camera idea because without proof, not much we can do/complain about.
