FSA/Childcare Tax Credit

Open enrollment time!  So I'm trying to decide if the FSA is worth it for us. 

I think I just read that with 2 kids, and maxing out the FSA, you can still claim the childcare tax credit. 

Has anyone done that?  Or am I interpreting this wrong?

  • Looks like with 2 kids you can claim another $1000 through the tax credit per this article.

  • I believe that, beginning Jan. 1, 2013, the amount you can write-off for childcare is being cut in half (from $5K to $2500). Also beginning next year, the dependent tax break you get is lowering from $1K to $500 for 2013 on.

    I believe this is only if Congress allows the Bush era tax breaks to expire, and would affect the 2013 taxes not our 2012 filings.

    Yup - they expire Dec. 31. (And I know this b/c this kid is coming BEFORE Dec. 31 for more than one reason!) I'm just not planning on the breaks being extended!

    So what will happen to the additional FSA money I've elected to take out pre-tax?  We need to determine that during open enrollment.

  • My understanding is, yes, someone can use the C&DC credit and the dependent care FSA, but you cannot claim your FSA contribution towards the credit. 

    The dependent care FSA limits will remain at up to $5,000 for 2013.  Only health care limits are changing. FSA's are use it or lose it, but I imagine most of us know ahead of time what our annual costs will be for dependent care.  Also, one thing to note about dependent care FSA's is that unlike health care FSA's, they are not fully funded as of the 1st of the year, they are only funded as you pay into them.
