Ex-wife withholding Information...

Hello Everyone,

 I am usually a private person, but my fianc? and I are at our wits end.  His ex-wife is refusing to give him any information regarding where their annulment/divorce took place, so he cannot obtain his Decree Absolute.  On top of that, she is refusing to give her address so that he may file.  From what I understand, it is a legal document and legally she was supposed to send him the documents, but she never did.  He is a British citizen and we find ourselves completely out of ideas.  Has anyone ever been in this situation?  Do you know of what else it is we could do?  We know there is legal help, but we are in no financial position to be able to afford that, and he is currently supporting us both in the UK, since I cannot work.  So please, any advice or help would be greatly appreciated.  As it stands, it seems like us being able to get married is moving further and further out of reach.

  • Your FI needed to have a copy of the divorce/annulment decree on hand.

    Contact her attorney. Tell them you need a copy of it --- the attorney who handled his divorce should have it also.

    I am not sure of what the divorce laws are in the UK, but an attoney that handled the divorce should have all necessary paperwork on hand. GL.
  • Why is she refusing? What does she want?

    How does it benefit her to give you what you want?

  • In the US, you could get a copy of his decree from the court or his lawyer. You wouldn't need her permission or anything. They are public records.  But I'm confused because it sounds like the court hasn't issued the certificate yet? So is he still married?

    Also, a family friend was abandoned by her ex and still got a divorce without knowing where he was. They have ways to do that. You should get a lawyer. 

     

  • Does he know where she works? He could have her served there or possible post in the paper. Contact a solicitor and see what he advises. He is probably still married and it does speak well of him to not make sure the matter was settled.

    Go to the court house and speak to a clerk about steps to see if anything was filed. Did he ever sign anything?

  • If your husband is a UK Citizen but can't afford legal advice he can contact the Citizen's Advice Bureau. You don't qualify, so he would have to speak to them directly about it.

  • You can afford a wedding but not a lawyer to make sure genus divorced?  If he's actually divorced it would take a lawyer no time at all to pull the decree

     

    This whole situation does not reflect well on him IMO
