Nope. My mom wrote one up for the cost of a notary after my dad passed in 1999. May not have been entirely legal but it was in writing. I believe she also had two wittnesses sign it as well...to make it more official.
She wrote hers because after my father passed she learned that in Pennsylvania if you pass without a will everything automaticly is given to your siblings. Children get passed over. Its also about the same time she put me as a co-signer on her checking account as a just in case kinda thing.
We have one, and we went to an attorney to get it because we have a business as well as our personal assets. It was VERY helpful going to a lawyer. She explained things that I just don't think I would understand if I had read them online. There were certain ways to do things to minimize taxes to expedite things. We did a will for property/assets, custody of DS, and a living will/advanced directive. That part was very helpful because now there is no question in my mind about DH's wishes should an accident or incapacitating illness happen. And he knows my wishes as well. It stinks, but families NEED to talk about that stuff.
It cost about $1,000, but again, I think the business aspect jacked it up. A friend paid about $800.
Children are not passed over if you don't have a will in Pennsylvania.

No but it is always on my list of things to do! I just can't decide on guardians. So everytime I think about the will I get stressed our about the guardian situation. I know that we need to just do it and settle but I keep pushing it off.
I do have the name of a lawyer that a friend used for their will so i was planning on calling them.
may i ask the lawyer's name? i wonder how much they cost. i'm surprised to hear the price fellow nesties have paid. i was thinking maybe $300 at the most!

I bring it up a couple times a year but we have yet to get anything done. Dh bought some software program that you just fill in and then have notarized. We have picked guardians for our kids. They are the best choice we have but honestly, I just feel like nobody will raise my kids the way dh and I would raise them.
no, but we really should. DH is a lawyer and wanted to do this years ago, but i wasn't ready to cope with actually doing it. i've been nagging on it since getting pregnant to do wills and living wills and we have yet to do it. now that DS is here we need to decide who the guardian would be and we don't want to name anyone that we know, except possibly my sister. we don't like the idea of grandparents, because they're not spring chickens and the child would have to go through a primary guardian yet again passing.
be careful of doing it yourself. simply writing things down and having it notarized isn't always a fool proof, fail proof, valid will. it is a legal document for a reason.
when you pass without a will in PA your assets go to your next in line heir. also, when you pass without a will in PA the spouse automatically gets a portion of the estate (i believe it's 1/3). spouses can NOT be written out of wills in PA. in order to write a spouse out of a will, or to not have them in the will, that spouse has to sign a form acknowledging that they are aware that they are not being stated as an heir to the estate.
i'm in WV and the atty i was working for did wills for $125 or $200 for a couple.
contact or google the website for the allegheny county bar association. that should be able to help you track down some lawyers that can help you.

My mother was told in 1999 that in PA children under 18 were passed over unless there was a will or someo documentation of wishes. Property would be first past to the parent's siblings.
This is not true.
