Should we walk??

We have the opportunity to close about 2 weeks sooner than originally thought.  The seller will be staying in the home 60 days after closing and has said no to an earlier closing date.  I told our realtor to let the sellers agent know that we really would like to move up closing and to ask the seller again.  She said she is worried that if we push more on the issue the seller will back out (can she do that?!)  We also just found out that the seller has been told by family, friends and her realtor that she should NOT sell her house!  We are under contract and just waiting for the loan to get out of underwriting.  We have done everything asked for by the seller and have been very accommodating by allowing her to stay in the home 60 days after closing.  I'm so torn about what to do!  Wait 6 weeks and have the seller possibly not show up to closing or tell our realtor to ask for the earlier closing date and if the seller decides she not selling anymore and deal with that???

    DD2(2.5): Late term premie due to PTL, low fluid & IUGR, Reflux, delayed visual maturation, compound heteroygous MTHFR, PFAPA, Bilateral kidney reflux, Transient hypogammaglobulinemia 


  • I would. I think paying for someone ELSE to stay in YOUR home for 60 days is crazy! Also, your homeowner's insurance will be paid for anything that happens in that ouse during that time. Are you prepared for that?

  • We have put over $2K into the house already; earnest money, inspection, appraisal.  Her staying in the house is all worked out in the contract; she would pay our mortgage and utilities and our insurance is not to cover her person property or any inju
  • I would stay under contract.  You will lose your earnest money if you walk and it sounds like you really like the house.  You can start looking at other houses now in case she walks.

  • Does this mean that she is technically renting from you for two months? Unfortunately, I would have her covered by insurance since if something were to happen to her, she could sue you, just like any other renter.

  • Hire a real estate attorney immediately! 

      

  • You should start looking other homes this will be beneficial for you.
  • I assume that since you are under contract you have a post closing possession agreement worked out by your attorney with the seller, as well as a tentative closing date in writing.  This should really be all you need.  Our post closing posses
