At the end of March, I received a letter from my health insurance company saying that one of their previous employees sent pictures of me, along with my personal information, to himself. These pictures were from seeing a plastic surgeon for a breast reduction. It's been a long and frustrating process so far in figuring out what action I can actually take. I want this guy to be held accountable and punished for what he did. It's sick! I've contacted several lawyers and they all tell me that I don't have a case for several reasons that are ridiculous but no way around. I'm in contact with an FBI agent that's been assigned to this "case" and I've been told that they are basically still trying to figure out if and what they can charge him with. Oh, and to top it off, this sick jerk lives an hour and a half from me!

That is beyond scary, gross and creepy. I wish I had a suggestion as to the course of action you could take. Chin up, and hopefully the agent will find something that will stick, so this creep gets what is coming to him.
Is it possible that he received the photos as part of a health insurance claim and misappropriated them? If so, I'd contact the company again.

I would be completely creeped out by this too! Hopefully, you can find a way (or a lawyer) who can bring justice to you and anyone else affected by the actions of this creep.
It is a HIPPA violation and I can submit a complaint with HIPPA against my insurance company which would result in an investigation and most likely a fine. I'll probably submit the complaint, but I want to see what action I can take against them first. Individuals can't sue for HIPPA violations, which is ridiculous. I'm still trying to figure out what other avenues I can take.
As for the individual, they are still trying to figure out what they can charge him for. They also have to prove that he did take the pictures, see what he did with them, and if he still has them. My insurance company made him sign an affidavit indicating he has not retained, shared, or allowed access to copies of the pictures and information. At this time, I can't do anything about it. I just have to sit and wait.
In the meantime, he knows my name and can pretty much find out everything that he wants to know about me on the internet. I am the only person in the USA, maybe even the world, with my name. My last name is extremely unique and everyone with that last name is related. It's the icing on the cake!
That is incredibly creepy! I don't understand how if your insurance company knows he took this information there is no legal action that can be taken, especially since this is the second instance with this man taking this kind of information.

Thanks ladies. I have searched my name and thankfully those pictures don't come up. But, you can pretty much find out everything about me which almost seems worse. It sucks because it's not like I took nudey pictures or anything; it was for a medical issue and it never crossed my mind that something like this could happen with those.
The authorities are investigating what really happened. All they have is my insurance company telling them he did this. They have to come up with the proof and piece it all together. So, it's just a "hurry up and wait" game right now.
