Did anyone not qualify for FMLA?

Hi there,

My DH and I are currently TTC. I just started a new job in the last week of April. I really like it there. 

This is only our 2nd true month of TTC (most girls here know all the complications I had before we were officially allowed to try). I'm now in CD 47 and my doctor order provera for me that I need to pick up on Monday. Last night, I POAS just to make sure I wasn't pg before starting it. It was a BFP. I had taken a test CD 30 and it was BFN. (We only STd 2 times in that span) I am calling my doctor for a blood test to confirm. I currently have a UTI and I don't know of that would affect the results on a HPT.

While we would be so excited, this means I would not qualify for FMLA in PA. I would only be there for 10 months when I'd be due. Does anyone have experience with this? What happened?

  • First of all...CONGRATS!!! Hope you get confirmation from your doctor real soon! :) exciting!!! 

    As far as FMLA, I did not qualify. I work for a company that only has 8 employees. I am in Wisconsin so I only am familiar with that but WI still has a law that companies must provide at least 6 weeks maternity leave even if you don't qualify for FMLA. So, that's what I will get. 6 weeks unpaid. Sucks but I will take it.

    I don't have any info on FMLA, but congratulations!! And a UTI should not impact a pregnancy test result. Good luck with everything!

    Congrats! I've heard of some companies who although an employee does qualify for the leave provided in FMLA, still allow a person to take the leave. I'd recommend contacting your HR department when you feel comfortable doing so and ask them what their policy is.

  • Thanks, ladies. If I get a confirmed BFP I'm hoping that my job will work with me but I know nothing is guaranteed. I've been having a ridiculous amount of sharp pains on my lower right side today though (it feels the same way when I get cysts). Also (TMI) brown spotting when I wipe. With a history of PCOS, endometriosis and being on an anticonvulsant, I'm petrified about the possibility of something being wrong.

  • Congrats! I hope a blood test confirms the BFP!

    I'm almost positive that although you won't qualify for FMLA your employer has to provide time off. I think it's 6 weeks. It can be paid or unpaid, that will depend on your employer. And they might not have to hold your job, but when you come back they have to put you in a position that is equal to or better than the position you left.

  • i didn't. it wouldn't have mattered anyways since i worked for a business that was too small to be held to FMLA standards (i believe there have to be 50+ employees). 

    i started the job jan 1. my cycle started around jan 20. i was with an RE and POAS around feb 21. i told my employer the day after our 6w u/s came back with good news so that they would know the situation since i was going to have a lot of dr's appts, possibly some at the last minute if i was having complications.

    they held my job for me and i was supposed to return to work on jan 2. a week prior i went in to tell them that i wouldn't be returning at all.

    i remember discussing the lack of FMLA situation with my husband (lawyer) and he said that generally speaking while there may be times when an employer isn't required to follow FMLA that it is smart for them to do so to avoid any potential law suits (ie, i was terminated for being pregnant).  

    Thanks to our wonderful RE our family is complete!

  • I didn't qualify for FMLA--I'd worked there 4 years but we had <50 employees. I used my accrued sick days as my maternity leave. Congrats! And good luck with the work situation.

  • FMLA is federal law (Family Medical Leave Act).

    Your state may have leave laws as well. Maternity and/or disability.

    I would start with the Labor and Industries website for your state.

    Congrats! I also didn't qualify for fmla but we are so small and like a family, I worked something out with my company. I had 3 months off and paid for my insurance. However, I had disability pay for my 8 weeks (due to c/s). Not sure how it is in PA but I live in CA and found info on edd website. Good luck!

    I live in pa too, but I'm not sure of the laws. The PA Dept of Labor website may have information, but it may be easier to call them.

    awww, congrats, pennstated! I know next to nothing about FMLA, but I'm pretty sure a UTI won't give you a false positive HPT. Yay!!

  • I got pregnant a few months after starting my new job.  I was 3 weeks short of qualifying for FMLA and I realized this shortly after I got my BFP.  I talked to my boss and she said that I could have as much time off as I needed.  She was not required to hold my job because I didn't qualify, but she did because she wanted me to come back.  I took 14 weeks.  Talk to your boss and see what they can do.  I work for a large state hospital, but it was my boss' choice to hold my job.  I did not get paid for it, but I was able to take that time anyway.  You are allowed 6 weeks for vaginal birth and 8 weeks for a c/s, that is considered medical leave and they are required to hold your job (I think - someone please correct me if I'm wrong).

    First, congrats! 

    I don't get FMLA because our company is too small to be covered under the law.  My suggestion would be to look at you employee handbook to see what maternity leave policy they have and as soon as you are comfortable going public to sit with your boss with a request for your leave and a plan for covering your job while you are out.  you can negotiate from there.  Get whatever you agree to in writing and in the meantime, start saving as much as you can to cover lost pay.  Do you have short term disability?  Those policies will usually cover pregnancy as long as it was in effect for a month before you got pregnant.
