Seller's Lawyer Issues (Vent)

I apologize for the vent. I'm just SO frustrated right now.

We are supposed to close on our house on Thursday at 1pm. We have had a long wait (3 months) for the closing due to the seller having a tenant in the house....well....3 days before the closing (today) the seller's lawyer is arguing with our lawyer because we want the final numbers for our closing so we can cut the check and budget for the rest of the month. He first admitted that he didn't realize that the 1st was this week (apparently he didn't know that there are only 31 days in July). Now he also wants to change the time of the closing to better accommodate his needs/schedule (which means my husband has to take the WHOLE day off from work and not just 1/2), never mind that we have been the ones that have been extremely accommodating to the seller (who wanted double the deposit and wanted her tenant to live in the house 2 weeks after the lease ends) and seller's lawyer, who threatened us with the other offers (there were 6 total on the house) because the house initially failed the radon test and we wanted another one done. 

 I know this is probably a rambling mess of a vent and probably makes me come off as a Queen B, but I feel better. Thank you all for your patience. [:)]

  • Where's your lawyer in all this?  I would definitely be threatening legal action if the closing date doesn't go through as planned.  As far as the tenant goes, if they have a loss because their tenant moves out early, that in no way concerns you legally.  They should have made an arrangement with their tenant before accepting that tenant, or should have countered with those conditions when you made an offer.  This is ALL on them, so I would definitely have your lawyer take care of it.  
  • Our lawyer is the one that we've been talking to. This is all coming from her. She's been in communication all day with the seller's lawyer....

     

    UPDATE: NOW the seller's lawyer wants to move the closing to Wednesday (our walk-thru is Wednesday night) because the seller will have to pay the interest on the mortgage for the entire month of August. Why wasn't this figured out BEFORE 3 days until the closing? I'm sorry, but you get what you pay for. We put our foot down and said, "No."  I'm a teacher, so I'm off for the Summer, but my husband had to request Thursday and Friday off from work (2 weeks in advance) in order to take care of the closing and moving this weekend. Our attorney flat out told us, that our closing is going to take longer now because we still don't have numbers and she doesn't trust that the numbers are accurate, so she is going through the docs item by item. I will just be so glad when everything is done, the house is ours and this all over.
