I see people talking about martial law happening. Do you think it will?
Re: Martial Law
Martial Law has occurred throughout various states throughout the history of the U.S. - as recently as 1961 in Alabama. This is an official declaration of ceasing the rule of habeas corpus by a the ruling governmental official (president, governor, etc.).
Martial Law was not declared in NOLA after Hurricane Katrina hit - if that's what others have referred to. It was more of a police state (check points, road blocks, curfews). The rule of law (civil law, civil rights, habeas corpus), had not be suspended. If it had, anyone who had broken the law would have been subject to court martial as done in the military. That did not happen.
I think that the terms "martial law" and "police state" are often confused and they need to be properly defined.
Can Martial law occur in the U.S. in the future? By state, yes it can and it did as recently as 1961. Could it occur over the whole nation? I suppose if one or both of two cases were to occur (rebellion and/or invasion). The U.S. Constitution has a provision for it, which reads, "the privilege of the writ of habeas corpus shall not be suspended, UNLESS when in cases of rebellion or invasion, the public safety may require it" (emphasis, mine).
I think where people are concerned, and rightfully so, is the continuation of presidents' going outside the reaches of their offices and violating the Constitution. Obama and George W. have both done this. While it seems like no big deal, "who cares?"...as more presidents do this unchecked and unchallenged, it will become easier for rights and rules of civil law to be taken from the citizenry of the U.S.. This should be a concern of every citizen regardless of political leaning and voting record.
Some people see the overreaches of past and current presidents as precursors to more over-reaching on American soil.
