Sorry to barge in here without knowing anyone but I really need some help.
Here is my situation: I have two children with my ex-husband who is currently active duty Navy. He claims both children as dependents and has them listed on his page 2. I am now married to an active duty Marine ( I know, I know.... I am medically retired Navy so I'm not one of those benefit chasers... I can't help that I like a man in uniform ). Well my Husband just received orders to Hawaii but the USMC will not pay for the children to go because they are not his dependents. They told us they only way that the kids could go to Hawaii is if their Father takes them off of his Page 2/DEERS/ETC. From what I understand you can't remove eligible dependents, even if he wanted to cooperate with us. He doesn't mind them going to Hawaii, he just doesn't want his BAH to change. I have primary custody of both kids. According to the JFTR because I have primary physical custody we (their stepdad and I) can put them on his BIR, but I don't know if that is the case when they are already claimed by another active duty member.
Here is my question: Can the kids be listed on both BIR and page 2? one for dependent status and the other for.... informational purposes as step children??
Is there any one out there who has been through this or can point me in the right direction? No one has been able to give me a straight answer so I'm hoping I can find someone who has been through it to offer some advice.
