Okay, maybe a stupid question ...

Okay, maybe a stupid question but let me explain.  I am having a surprise b-day party in a couple weeks for myself!  It's actually a surprise party on my guests.  I haven't given them any clues but just to show up at my house at a certain time.  Basically I am doing a photo scavenger hunt with my friends (shhhhhhhhhhh).  I am going to be on one of the teams and my friendly neighbors are going to be the judges.  So the question is about drinking.  Is it legal to have people in the car drinking?  Obviously not the driver but the passengers.  We are stressing that the driver not drink a drop and everyone will abide by this.  But is it okay for the passengers to have a drink with them in the car?

And if so, what can I give them for them to take a to-go cup with them?  

Sorry of this is a silly question but I don?t want to get people in trouble and I don?t want any issues.  I don?t drink at all and none of my friends are big drinkers but I want to make sure I have all the rules down before I tell people if they can bring or not bring a drink with them on the hunt.  The hunt will last for about 4 hours.  We are supplying all the alcohol for when they come back to the house, during the judging and campfire etc.  I think you all get the point so I will stop babbling on!

  • I am guessing here, but I think it's illegal. I've always thought that it would be too easy for a driver to say the drink is so-and-so's.

  • I *think* there is a "no open container" rule in the car for driver AND passengers.  However, being the bad citizens we are - always take thermos type cups on our way to tailgate . . .passengers NOT driver :)
  • absolutely not. bravo to you guys for making sure the drivers stay sober!! sounds like a fun party :)
  • No - you can not have any open containers of alcohol in a car (regardless of who is drinking them).
  • Okay, thank you for your help!  We will just do no drinking till after the hunt is over.  It will give them something to work for!  Thanks girls!
  • yw! we often turn games into drinking games, so maybe you could have them take a drink for every photo they get wrong or something like that :)

    there's a nestie on the D&R board who does this every year for halloween- one of her teams actually went skinny dipping in her parents pool to get the winning photograph!

  • LOL... reminds me of a good story from my serving days.  A man who was very clearly from rural KY asked for a to go cup for his long island iced tea.  I said no and he asked for a cup for his water.  I brought him a cup with water already in it.  He poured it out and the drink was gone when I came back.
  • Don't you live out of state?  In some other states, it's legal for passengers to have open containers, just not the driver (I know in TX for sure).
