I am so PO'd right now

So I go and get the mail when I get home last night to find a letter from Citibank waiting for me.  First thing that caught my attention was that it was from Citibank (I have not done business with them in the past) and second it was addressed to me in my "prior" married name.  It was a bill for over $5K on a Visa card that is now being turned over to collections for lack of payment.  Ummm, I do not have a Visa card with Citi.  So I called them and of course I get the surprise of a lifetime, actually just another feather to add to the cap of my ex's tricks.  My ex opened this credit card account literally a month before we separated, used my name as an account holder as well then had a good time.  He paid it promptly up until a year ago so I would have had no idea without running my credit report (which I have done this morning from each agency!!). A year ago he met a girl and ran up the card to over $5K and stopped paying it.  So now, since my name was on the account to, they are sending me bills and threatening letters.  According to my attorney, as we were still married, I am liable for the bill.  Great!!!!

Just what I needed .... the a$%hole has just PO'd me for the last time.  In looking at the credit report, there is stuff on there that he told me he paid off prior to the separation and divorce.  LIAR!!  Now I get to pay it off and clean it up.

I am ready to put on the highest stilleto's I can find and ram the heel up his arse!!!

Did this happen in Nevada?  I would pay the amount owed (negotiate it down of course--they are always willing to do that) and then turn around and sue him here in Nevada in small claims court.  It's easy to sue in small claims court, the costs are minimal, plus the costs can be recouped through the judgment.  If he fails to appear, you can get the judgment and execute it--garnish his wages and whatnot.  Just a suggestion based on personal experience, not legal advice! ;)  You could also threaten to do that and see if he ponies up and pays.  Doubtful I'm sure, but worth a shot!

  • Thanks for the suggestion and I have threatened to do things like court before.  He does not even pay 100% of his child support - I get $300 a month for two boys.  Hello!!!  Anyway, I just want him gone and then to find an email from his new girlfriend who he is so in love with ..... HE PROPOSED TO HER.  Lordy be, I hope she knows what she is getting into!
  • Yeah, I would do what m+j said, obviously. Ugh, what crap.
  • I agree you should fight it!!
  • sounds like your divorce lawyer slacked on his part.  They should have covered that.  Everyone I know has had credit pulled when they go thru a divorce.  Obviously mistakes happen, but that blows.  Sorry to hear all that Kim.  I'd do what they said and go after him.  *&#$@%! Get the stilleto's out girl.

Why on earth is his girlfriend or I guess now fiance emailing you and why is she telling you they are engaged now on top of that.  Personally I would tell her what he did also.

If you didn't know that he opened a card under your name that is a little thing called fraud!  Your lawyer didn't pick up on that?  Hello - you didn't authorize anything fight that with all you have.  Don't pay a dime!!!!  Just because he was your husband at the time does NOT mean that he can open credit cards in your name ESPECIALLY without you knowing it.  Get yourself a NEW lawyer and fight this fraudulant charge with all you have!  GL
