Lawyer Anyone?

So, I have finally been able to work out terms of a divorce from my H hoping that we could just file ourselves....

However, since this is the first time i have ever had this happen, I am not sure on wording a perticular part.  The only thing we have jointly is a condo.  We just bought it and he is retaining custody of it.

How do i word on the documents that he has to one way or another remove me from the loan, (via selling it, refinancing it, or releaseing my liability/buying me out).  Do i need to set a date for this at all if its not done by the time the divorce is final?

Re: Lawyer Anyone?

  • I'm not a lawyer, but I got divorced in 2002 from my XH and we did not use lawyers at all.  The paperwork was filed through  the county courthouse and we worked the agreement through until our court date.  We did not have a home involved in the settlement, but I took the car we had financed together.  We went to court and they gave me a deadline to get the car solely in my name (1 week.. maybe).  I would talk to the people in charge of filing at the courthouse to verify everything.  We also had no children involved which made it simpler.  The date is set by the court and you will have to take off work to appear in front of the judge together.  The judge will word the documents in the divorce decree.  I googled most of the information.  There is also a 90 day waiting period from the date the paperwork is filed.

Again, I would consult the courthouse since I am not a lawyer and it has been a few years.  I hope this helps and let me know if you need anything.
