Advice on credit card issue...

I checked my credit report a few days ago to find a card I had cancelled had a balance of over $100 on it and was showing 90+ days delinquent.  I have not received ANY notice from the credit card company that a payment was due...via e-mail, phone, or mail.   

I called the CC company and told them not only had the card not been used in at leat a year, that I had called to cancel it back when I got the renewal last year. 

 They have no record of me canceling the card, so I guess it's my word against theirs since I did it over the phone... and the balance is for the annual fee and now late charges that have accrued.

 Do I have any rights here? Is there a way to remove the negative impact on my credit?  I haven't told Dave yet.  It's gonna cause a huge arguement as I have worked so hard to rebuild my credit the last 4 years and this basically brings it back down to shite again.  

I'm so upset!

  • Do you have an idea as to when you cancelled it (like the month)?  I think CC companies record all the calls, so they should have to go back and pull the tapes of the conversation.

     It might not work, but it's worth a try!

  • I would call and speak to a supervisor.  They're should still be a record of the call in the system and this is totally not right.
  • I agree with PP.  Call back and ask to talk to a supervisor and see if that will get you anywhere.  Ask them to pull the tape.  I think you can also dispute the charges through the credit rating people (I forgot the exact name for it).  Basically you say the charges aren't right, then Experian/whatever sends that to the credit card company and they get "x" days to respond. If they don't I believe it gets taken off your credit history.  You might get some useful information from Money Matters, if you feel like venturing over there.

    Comcast Cable sent me a bill stating I did not return a piece of equipment when we moved. ?That was in May 2006. ?

    I immediately called, and they stated I owed $$. I asked to speak to a supervisor (meanwhile, taking down all of their names).
    They still insisted that I owed, or if I had the receipt proving the equipment I returned (uh, hello, that was 2 years ago and that I wouldn't still have the receipts). ?They wouldn't budge.

    Finally I asked them, "please tell me the total amount of the equipment that I was charged so I can see if I paid by cc or check, etc. for the equipment". Yep, I was willing to do that. ?They told me- "I'm sorry, our system doesn't go back that far". ?Umm. And you expect me to keep a receipt from 2 years ago when your SYSTEM DOESN"T EVEN GO BACK THAT FAR?

    I was fuming. I asked to speak to another supervisor and they told me they would inform collections about the situation.

    Needless to say, I now owe nothing. ?They even sent ME a check.

    As PP said, they keep tapes, ask them to check their "call tracking system" with an approximate month/year of cancellation. ?You may want to run a credit check.. they may not have reported it to the credit bureau just yet. ?Ask them as well. ?

  • I'd definitely call back and ask to speak to a supervisor.

     

    Plus, there should be a note in your account from when the call was made.   If there isn't someone wasn't doing their job.
