Apartment question - wwyd?

so here's the deal.

we've been in our current apt. for almost 1 year. we're considering renewing our lease. I was able to negotiate the rent down to $175 less per month, but also really wanted to see if we would be allowed to have a washing machine (small portable one). there is a strict clause in our lease stating tenants cannot have any type of washer/dryer. I asked again if that could be taken out of our agreement. Our management said no, its too much of a risk for water damage/etc.

Here's the issue: We know the people in the apartment above us have a washing machine. a) we hear it on a regular basis. b) we've had a leak in our living room (serious enough that it damaged about 2ft of ceiling and soaked a rug) c) we've had soapy water back up through our sink once or twice.

Would you notify the management of this? we don't necessarily know the people above us, but this could result in them being kicked out. Not sure....

  • yep, I mean didn't you notify them when you had a leak in your living room and soaked rug??
  • Yeah, that leak is so not cool! Didn't the landlord investigate where it came from? Does the landlord know the people above you really well or are they related to them? Maybe they let them have a W/D but then realized any more would be a risk...?

    But i would totally report it. Big Smile

  • I would have reported back when the leak first occurred and then every subsequent time it happened. I also would have asked for $$ to replace the rug. Why shouldn't they get kicked out for having a washer when it is having a direct effect on the other tenants (ie, the drains and the damages)?

  • I totally would let them know. Having said that, if their washer was there before the lease then they're allowed to keep it. They're also allowed to keep it if they have a disability or something else that prevents them from being to go out & wash their stuff. So you may not get them kicked out.?
  • Our superintendent knows about every occurrence, but I have a feeling he never passed on to management - and yes its my fault for not telling them directly.

    Thanks everyone - i just had this weird feeling of not wanting to be the cause of someone getting kicked out of their apt. but youre totally right. its not right for them to be breaking the lease rules and not facing the consequences.

    p.s. my rug was never actually ruined - just damp for a few days.
