RP: paternity leave for IL

Hello there, we just moved here and I'm not clear on how much time off dads get after delivery. my husband spoke to his company and he gets 2 weeks off but what is the state law and which form do you need to fill out to get additional time? Believe me I've gone to the IL state site and I'm more confused than i was before. we're from California and did it fine there when we had our daughter so I'm not sure why I'm having such a hard time, ugh. thanks for ANY help!

  • You're not in Cali anymore. There is no state maternity or paternity leave in IL. Your husband is lucky to get 2 weeks.

    He can take up to 12 weeks unpaid under FMLA, which is federal, assuming his company has more than 50 employees at his location. Other than that, it's at his employer's discretion.

  • Ditto prior post- other than FMLA (which he may or may not get depending on his company), he gets whatever the company is willing to give him.
  • As an employment attorney, I want to tell you that you should prepare for LOTS of differences in CA employment law versus the rest of the country (And IL is actually pretty liberal too). CA is the bane of my work existence!
