anyone know anything about labor laws?

I've been looking online for info on FL labor laws and I'm not finding what I need.  Here's the story:

I work in a small solo practice MD setting.  We have 3 front desk people and 3 techs (I am a tech) Over Christmas the MD is out of the office on the 24th, 25th, 28th, 29th, 31st, and 1st.  He is paying us on the 25th and 1st only.  He has labeled the office as "closed" those days with no patients to be seen.  In a memo to us today he explained we may either take vacation time (we don't get sick time) or no pay for the other days he isn't paying us for.  He will allow one front desk person and 1 tech to work for regular pay. 

This sounds so weird to me.  He's always just paid us for the day's he's not in the office.  I feel like he's forcing us to use our vacation days or take no pay.  There are 3 people all fighting to work for each position and they are just leaving it up to use to fight amongst each other over it.  Is this even legal?  I never get huffy about these things but this just seems so wrong.  I don't wanna loose pay and I want to save as much vacay time as possible to snowball for when DH and I get pregnant so I have paid time off.

Am I over reacting or am I right?

  • I don't think you're overreacting, but I'm pretty sure it is legal.  My company does it too.  We use our extra holidays for most of our days off, but we usually have to take a day or two of vacation.  (Every now and then we don't have to take any!!!)  I guess I can't answer your question regarding the legality of it with certainty, but I can definitely understand your point.  I'm just so grateful to have the week off after Christmas that I have never questioned it.  If you find out anything, please post it.  I would actually like to know the answer to your question.

    the doc is closing the office between Christmas and New Years (many offices do this). 

    You will not be working - therefore you will not get paid.

    If I am reading this correctly -  He is giving you Christmas Day and New Years Day as holiday pay so you will have those 2 days on your paycheck. You can use vacation for the other days or take as un-paid. 

    My advice:  see if you can work a day or two as the tech person on call and then enjoy your time off!  If you can afford it, don't take the vacay days, just enjoy not being at work.  

     

  • I dont think you are overreacting at all. I would be mad too. And I understand your concern with saving your time for when you have a baby. Unfortunitly I dont think there is anything you can do about it. Think of all the people who are working construction right now who just dont have work. They get sent home those days without pay.

    Personally, I would soak up the time off...I hate working around the holidays!! Hopefully you and your co-workers can come to a fair agreement on who is going to work which days.

  • Sorry to read this... The company my husband works for closes the last two week's of the month, and they are unpaid... unless you save the 2 weeks of vacation you get each year... then you have 2 paid weeks. It sucks because we can't vacation any other time of the year without my husband's pay being docked. :( I would talk with all the ladies and see if everyone can alternate days.... so everyone can at least work a day or two to get the extra pay... does your vacation time roll over each year or is it a use it or loose it per year basis?
