Our tech team has launched updates to The Nest today. As a result of these updates, members of the Nest Community will need to change their password in order to continue participating in the community. In addition, The Nest community member's avatars will be replaced with generic default avatars. If you wish to revert to your original avatar, you will need to re-upload it via The Nest.

I paid a photographer to take some photos, back in April. ?I STILL don't have my photos, though my check was cashed in April. ?We have emailed back and forth for months and she has given me nothing but excuses.I gave her the benefit of the doubt for awhile, because I wanted to trust her. ?But the length of time is just unacceptable to me. ?Before I left for vacation, on June 26th, she promised me that they would be here "very soon" and were already on their way. ?She also offered me a refund of my money since this had taken so long. ?Also, as a "bonus" for my inconvenience, she was supposed to send me a cd of all the images taken during the session. ?I should add that she "tried" to send me this cd twice, but both times I never got it because she omitted my apartment number. ?When I finally got the cd, they were web-size pics only. ?When I contacted her, she said it was EITHER a refund or a cd of the high-resolution pics, not BOTH (this was NOT what she said in her original email) ?I didn't have time to get into it, as we were getting ready to leave, so I just said fine, I will forgo the refund in lieu of the cd. ?Well, I got home from vacation and neither my photos nor the cd are here. ?I am ready to lose it.

I have emailed her twice since coming home, but have not received a response. ?My email IS working fine now, it just wasn't when I was on the road.

I am tempted to call her at her home, since her business card has her number, but I feel a little weird doing so. ?DH is ready to take her to small claims court and report her to the NH business bureau (or something like that...)

I feel like I've been more than patient and understanding. ?I paid for a service and don't have the goods to show for it. ?Am I overreacting by being so livid? ?WWYD? ?Thanks.?

**EDIT** ?Kristen was right- miracles do happen. ?Miraculously, I received an email late this evening stating that my items were mailed on Wednesday. ?All I know is they better arrive tomorrow and she better have put the apartment number this time. ?I'll let you know what happens.

  • Did you sign a contract with her? 

    I would call her business phone and leave a message for her.  Tell her you want the photos by such and such a date.  If you have no luck with her business phone, then I would call her personal line.

  • i dont think you are overracting.  i would be pissed too.  I agree with the pp.  I would call her and tell her you expect the pictures by this date and if you do not receive them you will be contacting the BBB, your lawyer and who ever else you can think of.  I think a couple of months is more than enough time to get pictures done.  
  • small claims court is appropriate at this point.  i personally wouldn't think twice about that.
  • I don't think you are overreacting at all.  She's not being at all professional. 
  • I wouldn't even think twice about calling her house at this point!  This is ridiculous!  Calmy explain to her your frustrations.  Give her a deadline of say next friday or you will be taking her to small claims court.  Plain and simple: she rendered a service, you paid and still have not recieved the end product.  There are NO excuses anymore, time is up.

    I would be calling everyday until I get my pictures.

  • I agree, tell her you're calling your lawyer and the BBB, and if she doesn't do what you want (or at least what she said), go to small claims court
  • I think I know who you are talking about and if it is who I think, you are not the only person who has had problems with her recently.  Somebody is ruining their once good reputation with Nesties, that is for sure!

  • She hasn't delivered them yet? Damned, that's bad business....and it sucks. I bet they were cute pics too.
  • I think I know who it is too.  And if it is, you are not the only person this has happened to.  I would give a deadline b/f involving BBB, small claims court etc.  Good luck Jeanette!  I want to see Ben's pics!
  • I woudl call the home number, copy all my emails and responses from her and get ready to call BBB.  Tell her just that.  "I want the pictures that i paid for and the cd on my doorstep within 1 week, here is my address and my phone number.  I will be making phone calls to the BBB and my husband is contemplating small claims court, the choice is yours."  But you need to follow through!!  Otherwise you wont get anything.  Good luck.

     Kim Zay, you are pissing people off and making yourself look like a joke. Get people the pictures of their kids before they are 10! People have pictures taken of their babies so they can remember those innocent times and share them with family and friends. They don't want the pictures months after the baby is that age.I can assure you that you have ruined any future business that you may have had going with Nestie, cause you've screwed over too many people. It's a shame too cause I would have loved to have used you again. Get people what they paid for/were promised!!!!

  • ditto everyone else J.  I would contact the BBB, (I would be surprised if there isnt some negative responses for her already) and def take her to small claims court. 

    Also- going forward for Ben's photo's there is a wonderful photographer who is right around the corner from you that I would highly recommend.  She is not cheap but her photos are  breath taking.  She has work that is displayed in the Smithsonian and at Epcot plus a ton of other places.  I am so glad that I brought Connor to her.  You can always go see her in her studio (seriously right down the street from your home) and see all the beautiful baby photos she has posted then see if she can fit in your budget.

    Either which way you need to get your $$ back from Kim.  Her actions are completely unprofessional and its really sad that she has ruined her name with so many moms in the NH area but she did it herself.

  • I'd send a demand letter certified mail. If you don't get anywhere and you go to small claims court it shows evidence that you attempted to resolve the issue. In the demand give her 30 days to respond then take her to court. Good luck.
  • Oh goodness.  I wish that this post hadn't been made - simply because I think that this could have been taken up directly w/ Kim and not here on a public forum.  THAT being said, I can't feel badly that it WAS made.  I did not have a good experience, either.  I waited far too long for announcements and had to email several times to question their whereabouts.  I finally got them but that was after I stopped payment on the check that had been issued.  I was convinced we weren't getting our announcements and I was horribly disappointed because they were beautiful, beautiful, beautiful.  I was told not to pay for them, so that was nice, I thought.  However, I still haven't received my free wallets as a "thank you" for allowing pictures to be taken of my daughter when she was a newborn, to help promote this photography business.  I am greatly disappointed in the lack of professionalism - really nice person, very bad business woman.  Not a way to run the show and certainly not the way to treat customers.  I don't understand.

  • This was a business deal... treat this person the same as you would anyone else....

     BRB, small claims court, and plastering it all over the nest and knot.

    Don't let others get stuck with the same crappy service- too many people have already suffered.

    See Amye, I DID try to take this up with her directly, MANY TIMES, and she had not responded. ?I didn't page her on here or blast her like I really wanted to. ?I didn't mention her name or the fact that it was my maternity photos from December, so that no one would know who it was. ?I was purposely vague on that. ?I brought it to a public forum simply because I wanted to know what other people would do if they were in my situation. ? DH was ready to file a claim today and I wanted to hear what others had to say.

    The bottom line is, she is the one in the wrong here. ?I wanted advice and these are the women I come to for that.

    Also, I am sorry to hear that you didn't have a great experience either. ?At least you got your pics though and for free. ?It would be nice if she would follow through and give you the wallets you were promised.

    Hopefully, my things will come in the mail tomorrow and this can be put behind me. ?I will certainly NEVER recommend her to anyone ever again.?
