QUESTION.

I need some help.

If J and I were married in CA, or MA, would it be easier to change our names on our SS Card in those states, or would we still have to go through the court system? Because don't they just need a marrige liscense to do so? This name change process is becoming very complicated. Help PLEASE!

  • In MA, the marriage license is a legal name change for your last name.  So you can both change your last names. 

    Your last name legally changes via the marriage.  So you can go to SS Office and change your name on the card.  You don't need to go through the court-it's automatic w/ a valid marriage.

  • But I just looked and saw you were 19 and that's way too young to get married :)

  • unfortunately that info is only accurate if you are a Mass resident. and you can only change your name on your passport with a legal name change.

    its a huge pain in the a s s but the only way to go is a legal name change through the courts. sorry, i know it sucks.

  • Marriage may help you change the SS card but it doesn't do a damn thing for the passport.  Therefore you will still likely need a court order.

  • Go through the court!  As Elise said, it only applies to MA residents, and even at that - if you want to change your name on your passport, the passport agency requires a court order. 

    Even as a MA resident, my name is not "legally" changed until I get a court order.  Even though I'm Mrs. F on my license, SS card and every other freaking document I own, it's not "legal" until a judge rules it so.

  • It just seems so crazy, that we have to jump through soooo many hoops. I am a bit nervous about having my court hearing, and 'pleading' my case in front of the judge. It makes me nervous.

  • Depending on your local court - you may not need to.  Here in MA, we just submit the paper work and a judge reviews without you even present.

    You shouldn't need to plead at all - we are commiting to one another for life, we cohabitate, share finances and plan to have children. We want one last name for our family - simple as that.

  • Thanks Brit, those words make it seem much easier, but yes in Oregon, I do have to go before a judge and the process takes 4 weeks!

    It just makes me nervous.  I will be waiting untill, I return from Mexico, to do this. I need nothing to delay getting my passport.
