Our tech team has launched updates to The Nest today. As a result of these updates, members of the Nest Community will need to change their password in order to continue participating in the community. mass vote

the state legis. seems to be taking a vote today on repealing the 1913 law that prohibits the out of state gay marriages in ma.  cross your fingers that it passes.

    I love how the opposition keeps saying that repealing this law will make MA "the Las Vegas of gay marriage," like it's a bad thing...

  • I am slightly confused. Is this law to allow Mass to recognize out of state gay marriage, or for other states to recognize Mass's gay marriages?

  • Currently, if you are a same-sex couple that does not live in MA, you can be denied a marriage license here.

    Some places will give them (like PTown!), but they are technically required to refuse under a 1913 law that prohibits granting marriage licenses to out of state couples whose marriages would not be recognized in their home states (the law was written back when interracial marriage was only legal in some states).

    Some city clerks think it's enough if you swear that you will live in MA in the future.

    If the legislature decides to repeal this law, then out of state couples will be issued marriage licenses in MA with no questions asked.  Their home states still won't recognize them (unless they are from CA or NY), but they will be able to at least get the license.

  • I was so happy about this! Now the House vote, and Patrick's [very willing!] signature.

    This is such great news, however, something that hasn't been discussed is the effect this has on couples from out of state who were married in MA while the law still prohibited it. I suspect that those marriages will not be recognized in MA and would have to be performed again in order to be legal even in MA. As far as I know, couples who got married while the law was in effect do not have standing to sue their home states for refusing to recognize their marriage which is legal in MA.

    This is complicated, and there will be no concrete answers until people start to move to do those things and get either approved or denied.

    Meanwhile, I hope lots of couples have the resources and ability to come to MA [or CA!] to get a formal license. :)
