Ugh, I'm losing my faith in my place of employment. Our graphic designer, who is woefully unpaid, has been called to jury duty. My boss just announced that she has to take vacation time or she won't be paid. My manager is shocked. I'm surprised too because J was recently on jury duty and he was paid by his company. Graphic Designer is already helping to support her boyfriend who lost his job. $40 a day will not cut it.
I guess technically and legally boss doesn't have to do pay her . . . but what about all those extra hours graphic designer worked without pay because she's on salary? It's not like we even get comp time. Why to show how grateful you are for all her hard work.
I guess I'm just bummed in general. The weather blows, I haven't seen the sun in days, all that yackity-yack.
I'm ready for spring. And a new job.

Yup, legally they dont have to pay her
which is so lame. BUT she could have declined it and stated financial issues or whatever the option is.

Unfortunately my manager assumed the owner would not be a cold hearted jerk and told the graphic designer that since it was her civil duty, she would be paid, no problem. After graphic designer gets booked on a case, the owner says no way jose. Manager is stunned. Graphic designer can longer plead financial issues.
Although there may be legal action she could pursue in that case . . .

NY has kind of lousy employee law. It looks like because our business has less than 10 people, she's not to required to pay graphic designer.
I saw graphic designer when I came in this morning because she came in early before jury duty to finish up some work (because she's, you know, a good person). I don't think she knows yet.
This just motivates me to research into my state's policies regarding overtime/comp time when you're salaried. If I ruin that for my boss before I leave, I'll be a happy lady!
I would certainly think so, and I would pursue it!
