Hit by an uninsured motorist???
1st, i'm so frustrated with the nest... i've been trying to post for days now, so we'll see if this works!
I had posted a while back for body shop recommendations.. (we went w/Schaeffer off Hwy 30..thank you!)
Here's a C&P from a post on another board, but i didn't get much response, so thought i'd post it locally:
I got rearended (very minor) a month ago and the lady acted all nervous when i called the cops, etc...long story short, she just wanted to pay me, etc. so i take a day off work, get the estimate and now she's saying she didn't do any damage to my car (my brand new car, might i add), blah blah. the estimate was almost 1200.00! now come to find out, she has NO insurance. i'm beyond pissed and now know why she was acting so nervous around the cop. i have called and left a message for the cop to see if he can ticket her (because she's still driving around w/no insurance) but i was wondering what my other avenues are. i'd like to prosecute to the fullest just out of spite and i know it's not a lot of money, but this lady is a scumbag! here i am paying my insurance like i'm suppose to and i'm sitting still at a stop light and she hits me... then, tells me a month later that she doesn't remember any damages? like i just bought this car dented... UGH.
Does anyone have any experience with this and any ideas of what to do? I'm currently trying to just get her to give me my $500 deductible and let my insurance deal with her, but i'm pis*ed now. LOL. she's a lying scumbag and i want to at least give her hell for a while. LOL
any ideas of what to do or who to call?

My follow up: She doesn't have insurance, and my mom mentioned that maybe i could take her to small claims court to recover my deductible..she may not pay it now, but i guess eventually she'll have a judgement against her and i'll get my money?? also, i looked her up and she's got about 6 other small claims court judgements against her (nice huh?), so she obvioulsy knows the system.... i've left a message w/an attorney, but i have a feeling since she doesn't have insurance, he won't be able to do anything. i don't want to get my car fixed yet, because, frankly i don't have $500, but in order for my insurance company to go after her, i have to get it fixed... it's so frustrating and no matter which way i see it, i'm out money for an accident that was 100% not my fault!
does anyone know anything about small claims court or any other avenue i can go to get this *woman*. she's still driving around w/o insurance.. OH, i should add that i have spoke w/the officer since then and he said unfortunately there's nothing he could do because she would have presented him w/the same insurance card she did me and he would have had to take it at face value?? my sister (who has worked at a police department for over 10 years) said she should still be ticketed and her license revoked... this lady is going to get away with this isn't she... UGH!

That really, really sucks! I had an uninsured motorist hit me about 5 years ago. The only thing is I didn't call the cops because she showed me an insurance card so I took the info and proceeded to go to work. When I called the insurance company they said that the policy # on her card was lapsed and she had called that morning to reinstate her insurance AFTER the accident and therefore she was uninsured when she hit me! She then offered to pay me out of her pocket and when I got the estimate her BF said that was too much $$ ~ I never saw one red cent from her. So I was screwed.
Seems to me that the cop just doesn't want to bother with it, I would show up at the precinct and talk to the Captain and let them know that you expect that they at least ticket her!
Also, I'm not sure if this is right or not because I've never used small claims court, but I don't think you need and attorney.
