Condo and HOA rules?

So recently we received a letter from our HOA asking us to provide them with tenant information?  I forget the exact "professional" name they came up with for the form.  We've owned the place for 6 years now and this is the first time I have seen this form.  Basically they want all kinds of information on my tenant if we rent the place out.  Well we do.  I just don't think its any of their business to know this.  It would also require that our tenant sign all this paperwork in like 87 different places.  Just a pain in the rear.  I mean, what if my tenant said he didn't want to sign?  Not to mention, I'd really like to keep the IRS out of this.  Embarrassed  I know, I know.......I should be paying taxes on my renter.  But we don't. 

Have any of you that own a condo with an HOA ever received something like this?  It says in the letter that we MAY get a fine if we don't supply this info.  Years ago, they made all of us owners change the type of garage door we had.  Well we were threatened then with a fine if we didn't do so.  So we jumped on it.  To this day, there are still units that have never upgraded their garage door and they were never given a fine.  So i'm thinking of just waiting this out.  What do you think?

  • I would think you are only required to provide that info if it is in the CC&R's.  Where I owned a condo (in Corona btw), the HOA limited the percentage of renters in the complex to 5%.  I don't remember the exact rules/bylaws, but there was a process with the HOA before you could rent your place out and if you didn't abide, you were swiftly fined.  Part of that was providing the renter an official copy of the CC&R's which the owner and renter had to have notarized, so I guess that's how my HOA got all the info they wanted.  Personally I wouldn't wait it out, I would contact the HOA and push back on them.  

  • MH has a condo in Issaquah, WA and just received a letter similar to yours. I read through it briefly, and it seems more of a formality in updating their records. They are asking for the tenant's name, car info, how many ppl are living there as well as serial # for the water heater and other major appliances in the unit. Some of the requested information seems weird...and I think he's waiting to send it back as well.

    About having to change out your garage door to be more uniform reminds me of a situation in our other property. They made everyone in the complex (pretty big housing comlex) change cable companies to save a measly 10% and it will be included in the HOA!!! Angry. And at the time, we had a contract with Directv so MH fought it with the HOA and they haven't said anything since then. Very annoying!

  • As a landlord that just had their property completely destroyed...I would fill the info out.  That way you have proof of who and how many are supposed to be living there...if it turns out to be ugly, you have third party proof. 

    Being in a condo, it is the HOA's business to know exacty who is living there. The IRS won't know about it unless you have a prop manager that is filing a 1099 at the end of the year.

  • that is annoying - but HOAs are annoying in general.  Read your HOA agreement to see what it says.  I think it's pretty standard for them to need to know which units are being rented out, but the length of the form and info they are requesting might be too broad for the contract...
