Deposition update
Thanks for the dust. Basically everything went even more in our direction. The guy openly admitted to not following the statutes issues by the Texas Condominum Act, which is Texas law. So.... what else can you say? His lawyer threw a fit and was in a yelling match with my lawyer for a while, but I just sat there and watched. So at this point, we wait to see the next step. They might depose me about whether or not I had knowledge about his building the house, which after the deposition yesterday, the guy admitted to only showing us house plans and not site plots as well as not informing us that he was blocking our only access. My lawyer was also able to obtain pictures from my house, not only the walkways, but also the balconies that show that with the overgrown trees there was no way to see his house from mine or from the road. (Any of you who have been to my house know that it's on a cliff so you cant see anything until it's already built).
Additionally, I have proof of my lab studies going on during that time both in San Antonio and here in Austin that had me out of my house before the sun came up and home after the sun went down. Basically, my credibility is sealed and good, so that works in our favor.
THey have the option to depose me, but they probably wont so we are now going to set a trial date so that we can move on to mediation. With his sworn testimony to openly breaking the law, there is good hope that he will be forced to settle. So..... wohoo! Either way, this will be over before the end of the year for sure. After 3 years. Thanks for the dust. It was very much appreciated. Off to lab!
